76 AN ACT
87 relating to the reimbursement of certain urban teaching hospitals
98 for the provision of inpatient hospital care under Medicaid.
109 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1110 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1211 is amended by adding Section 32.0285 to read as follows:
1312 Sec. 32.0285. CALCULATION OF MEDICAL EDUCATION ADD-ON FOR
1413 REIMBURSEMENT OF CERTAIN URBAN TEACHING HOSPITALS. (a) In this
1514 section:
1615 (1) "Base standard dollar amount" means the
1716 standardized payment amount calculated by the commission for costs
1817 incurred by prospectively paid hospitals in this state for
1918 providing inpatient hospital care under Medicaid.
2019 (2) "Children's hospital" means a hospital designated
2120 by the Centers for Medicare and Medicaid Services as a children's
2221 hospital.
2322 (3) "Medical education add-on" means an adjustment to
2423 the base standard dollar amount for an urban teaching hospital to
2524 reflect higher patient care costs relative to nonteaching urban
2625 hospitals.
2726 (4) "Rural hospital" means a hospital enrolled as a
2827 Medicaid provider that:
2928 (A) is located in a county with a population of
3029 not more than 60,000;
3130 (B) is designated by the Centers for Medicare and
3231 Medicaid Services as a critical access hospital, sole community
3332 hospital, or rural referral center and is not located in an area
3433 defined by the United States Office of Management and Budget as a
3534 metropolitan statistical area; or
3635 (C) meets all of the following criteria:
3736 (i) has 100 or fewer beds;
3837 (ii) is designated by the Centers for
3938 Medicare and Medicaid Services as a critical access hospital, sole
4039 community hospital, or rural referral center; and
4140 (iii) is located in an area defined by the
4241 United States Office of Management and Budget as a metropolitan
4342 statistical area.
4443 (5) "State-owned teaching hospital" means:
4544 (A) The University of Texas Medical Branch at
4645 Galveston;
4746 (B) The University of Texas Health Science Center
4847 at Tyler; and
4948 (C) The University of Texas M.D. Anderson Cancer
5049 Center.
5150 (6) "Teaching hospital" means a hospital that incurs
5251 indirect costs for operating graduate medical education programs
5352 and for which the Centers for Medicare and Medicaid Services has
5453 calculated and assigned a percentage Medicare education adjustment
5554 factor under 42 C.F.R. Section 412.105.
5655 (7) "Urban hospital" means a hospital that:
5756 (A) is located in an area defined by the United
5857 States Office of Management and Budget as a metropolitan
5958 statistical area; and
6059 (B) is not a rural hospital, children's hospital,
6160 state-owned teaching hospital, or freestanding psychiatric
6261 facility.
6362 (b) To the extent permitted by federal law, in order to
6463 ensure that urban teaching hospitals are accurately reimbursed for
6564 the provision of inpatient hospital care to recipients under
6665 Medicaid, the commission shall, on request from a teaching
6766 hospital, update on a biannual basis the education adjustment
6867 factor used to calculate the medical education add-on using the
6968 most current Medicare education adjustment factor data available
7069 under 42 C.F.R. Section 412.105 at the time the commission makes the
7170 update.
7271 SECTION 2. If before implementing any provision of this Act
7372 a state agency determines that a waiver or authorization from a
7473 federal agency is necessary for implementation of that provision,
7574 the agency affected by the provision shall request the waiver or
7675 authorization and may delay implementing that provision until the
7776 waiver or authorization is granted.
7877 SECTION 3. This Act takes effect immediately if it receives
7978 a vote of two-thirds of all the members elected to each house, as
8079 provided by Section 39, Article III, Texas Constitution. If this
8180 Act does not receive the vote necessary for immediate effect, this
8281 Act takes effect September 1, 2021.
