| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 263.007, Family Code, is amended to read |
|---|
| 12 | 12 | | as follows: |
|---|
| 13 | 13 | | Sec. 263.007. REPORT AND AFFIDAVIT REGARDING NOTIFICATION |
|---|
| 14 | 14 | | OF RELATIVES. (a) Not later than the 10th day before the date set |
|---|
| 15 | 15 | | for a hearing under Subchapter C, the department shall file with the |
|---|
| 16 | 16 | | court a report regarding: |
|---|
| 17 | 17 | | (1) the efforts the department made to identify, |
|---|
| 18 | 18 | | locate, and provide information to the individuals described by |
|---|
| 19 | 19 | | Section 262.1095; |
|---|
| 20 | 20 | | (2) the name of each individual the department |
|---|
| 21 | 21 | | identified, located, or provided with information; and |
|---|
| 22 | 22 | | (3) if applicable, an explanation of why the |
|---|
| 23 | 23 | | department was unable to identify, locate, or provide information |
|---|
| 24 | 24 | | to an individual described by Section 262.1095. |
|---|
| 25 | 25 | | (b) The report under Subsection (a) must be accompanied by |
|---|
| 26 | 26 | | an affidavit affirming the contents of the report. |
|---|
| 27 | 27 | | SECTION 2. The change in law made by this Act applies to a |
|---|
| 28 | 28 | | suit affecting the parent-child relationship that is filed on or |
|---|
| 29 | 29 | | after the effective date of this Act. A suit affecting the |
|---|
| 30 | 30 | | parent-child relationship filed before the effective date of this |
|---|
| 31 | 31 | | Act is governed by the law in effect on the date the suit was filed, |
|---|
| 32 | 32 | | and the former law is continued in effect for that purpose. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect September 1, 2021. |
