55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the required filing of a fetal death certificate for an
88 unborn child following an abortion.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 193, Health and Safety Code, is amended
1111 by adding Section 193.0035 to read as follows:
1212 Sec. 193.0035. FETAL DEATH CERTIFICATE REQUIRED FOLLOWING
1313 ABORTION. A physician who performs or induces an abortion shall
1414 file a fetal death certificate for the unborn child, regardless of
1515 the gestational age of the unborn child at the time of the abortion.
1616 SECTION 2. Section 674.001(2), Health and Safety Code, is
1717 amended to read as follows:
1818 (2) "Fetal death certificate" means a death
1919 certificate filed for any fetus [weighing 350 grams or more or, if
2020 the weight is unknown, a fetus age 20 weeks or more as calculated
2121 from the start date of the last normal menstrual period to the date
2222 of delivery].
2323 SECTION 3. The changes in law made by this Act apply only to
2424 an abortion that is performed or induced on or after the effective
2525 date of this Act.
2626 SECTION 4. This Act takes effect September 1, 2021.
