66 AN ACT
77 relating to required agreement provisions and eligibility of
88 certain games and events for funding administered by the Texas
99 Economic Development and Tourism Office.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 475, Government Code, as
1212 effective April 1, 2021, is amended by adding Section 475.0005 to
1313 read as follows:
1414 Sec. 475.0005. REQUIRED AGREEMENT PROVISION FOR POSTING
1515 HUMAN TRAFFICKING SIGNS. (a) An agreement under this subtitle
1616 between the office, an endorsing county or municipality, or a local
1717 organizing committee and a site selection organization that
1818 includes a financial commitment by this state or a county or
1919 municipality of this state must contain a written verification that
2020 the site selection organization will prominently post throughout
2121 the location of the game or event signs with information on services
2222 and assistance available to victims of human trafficking.
2323 (b) The office of the governor, in consultation with the
2424 human trafficking prevention coordinating council established
2525 under Section 402.034, shall by rule prescribe the sign format and
2626 manner of posting signs under this section.
2727 SECTION 2. Section 478.0051, Government Code, as effective
2828 April 1, 2021, is amended by amending Subsection (b) and adding
2929 Subsection (c) to read as follows:
3030 (b) A listed event may receive funding through the program
3131 only if:
3232 (1) a site selection organization, after considering
3333 through a highly competitive selection process one or more sites
3434 not in this state, selects a site in this state for the event to be
3535 held:
3636 (A) one time; or
3737 (B) if the event is scheduled under an event
3838 contract or event support contract to be held each year for a period
3939 of years, one time in each year;
4040 (2) a site selection organization selects a site in
4141 this state as:
4242 (A) the sole site for the event; or
4343 (B) the sole site for the event in a region
4444 composed of this state and one or more adjoining states;
4545 (3) the event is held not more than one time in any
4646 year;
4747 (4) the incremental increase in tax receipts
4848 determined under Section 478.0102 is at least $1 million; and
4949 (5) not later than the 30th day before the first day of
5050 the event, a site selection organization submits a plan to prevent
5151 the trafficking of persons in connection with the event to:
5252 (A) the office of the attorney general; [and]
5353 (B) the chief of the Texas Division of Emergency
5454 Management; and
5555 (C) the human trafficking prevention
5656 coordinating council established under Section 402.034.
5757 (c) The plan described by Subsection (b)(5) must provide for
5858 the posting of signs as required under Section 475.0005.
5959 SECTION 3. Section 478.0051(c), Government Code, as added
6060 by this Act, applies only to a plan to prevent human trafficking
6161 submitted on or after the effective date this Act. A plan submitted
6262 before the effective date of this Act is governed by the law in
6363 effect immediately before the effective date of this Act, and the
6464 former law is continued in effect for that purpose.
6565 SECTION 4. This Act takes effect September 1, 2021.
