10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter A, Chapter 475, Government Code, as |
---|
12 | 12 | | effective April 1, 2021, is amended by adding Section 475.0005 to |
---|
13 | 13 | | read as follows: |
---|
14 | 14 | | Sec. 475.0005. REQUIRED AGREEMENT PROVISION FOR POSTING |
---|
15 | 15 | | HUMAN TRAFFICKING SIGNS. (a) An agreement under this subtitle |
---|
16 | 16 | | between the office, an endorsing county or municipality, or a local |
---|
17 | 17 | | organizing committee and a site selection organization that |
---|
18 | 18 | | includes a financial commitment by this state or a county or |
---|
19 | 19 | | municipality of this state must contain a written verification that |
---|
20 | 20 | | the site selection organization will prominently post throughout |
---|
21 | 21 | | the location of the game or event signs with information on services |
---|
22 | 22 | | and assistance available to victims of human trafficking. |
---|
23 | 23 | | (b) The office of the governor, in consultation with the |
---|
24 | 24 | | human trafficking prevention coordinating council established |
---|
25 | 25 | | under Section 402.034, shall by rule prescribe the sign format and |
---|
26 | 26 | | manner of posting signs under this section. |
---|
27 | 27 | | SECTION 2. Section 478.0051, Government Code, as effective |
---|
28 | 28 | | April 1, 2021, is amended by amending Subsection (b) and adding |
---|
29 | 29 | | Subsection (c) to read as follows: |
---|
30 | 30 | | (b) A listed event may receive funding through the program |
---|
31 | 31 | | only if: |
---|
32 | 32 | | (1) a site selection organization, after considering |
---|
33 | 33 | | through a highly competitive selection process one or more sites |
---|
34 | 34 | | not in this state, selects a site in this state for the event to be |
---|
35 | 35 | | held: |
---|
36 | 36 | | (A) one time; or |
---|
37 | 37 | | (B) if the event is scheduled under an event |
---|
38 | 38 | | contract or event support contract to be held each year for a period |
---|
39 | 39 | | of years, one time in each year; |
---|
40 | 40 | | (2) a site selection organization selects a site in |
---|
41 | 41 | | this state as: |
---|
42 | 42 | | (A) the sole site for the event; or |
---|
43 | 43 | | (B) the sole site for the event in a region |
---|
44 | 44 | | composed of this state and one or more adjoining states; |
---|
45 | 45 | | (3) the event is held not more than one time in any |
---|
46 | 46 | | year; |
---|
47 | 47 | | (4) the incremental increase in tax receipts |
---|
48 | 48 | | determined under Section 478.0102 is at least $1 million; and |
---|
49 | 49 | | (5) not later than the 30th day before the first day of |
---|
50 | 50 | | the event, a site selection organization submits a plan to prevent |
---|
51 | 51 | | the trafficking of persons in connection with the event to: |
---|
52 | 52 | | (A) the office of the attorney general; [and] |
---|
53 | 53 | | (B) the chief of the Texas Division of Emergency |
---|
54 | 54 | | Management; and |
---|
55 | 55 | | (C) the human trafficking prevention |
---|
56 | 56 | | coordinating council established under Section 402.034. |
---|
57 | 57 | | (c) The plan described by Subsection (b)(5) must provide for |
---|
58 | 58 | | the posting of signs as required under Section 475.0005. |
---|
59 | 59 | | SECTION 3. Section 478.0051(c), Government Code, as added |
---|
60 | 60 | | by this Act, applies only to a plan to prevent human trafficking |
---|
61 | 61 | | submitted on or after the effective date this Act. A plan submitted |
---|
62 | 62 | | before the effective date of this Act is governed by the law in |
---|
63 | 63 | | effect immediately before the effective date of this Act, and the |
---|
64 | 64 | | former law is continued in effect for that purpose. |
---|
65 | 65 | | SECTION 4. This Act takes effect September 1, 2021. |
