7 | 7 | | relating to the temporary relocation of a residential child-care |

8 | 8 | | facility during a declared state of disaster. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 42.048, Human Resources Code, is amended |
---|
11 | 11 | | by amending Subsection (e) and adding Subsection (e-4) to read as |
---|
12 | 12 | | follows: |
---|
13 | 13 | | (e) A license issued under this chapter is not transferable |
---|
14 | 14 | | and applies only to the operator and facility location stated in the |
---|
15 | 15 | | license application. Except as provided by Subsections (e-1), |
---|
16 | 16 | | (e-2), [and] (e-3), and (e-4), a change in location or ownership |
---|
17 | 17 | | automatically revokes a license. |
---|
18 | 18 | | (e-4) To the extent necessary to comply with a state or |
---|
19 | 19 | | local order during a declared state of disaster under Chapter 418, |
---|
20 | 20 | | Government Code, the commission may authorize a residential |
---|
21 | 21 | | child-care facility to temporarily: |
---|
22 | 22 | | (1) relocate to a new location that is not stated in |
---|
23 | 23 | | the facility's license application; or |
---|
24 | 24 | | (2) provide care to one or more children at an |
---|
25 | 25 | | additional location that is not stated in the facility's license |
---|
26 | 26 | | application. |
---|
27 | 27 | | SECTION 2. This Act takes effect immediately if it receives |
---|
28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
---|
29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
---|
31 | 31 | | Act takes effect September 1, 2021. |
