| 10 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 12 | | SECTION 1. Subchapter M, Chapter 5, Water Code, is amended |
|---|
| 12 | 13 | | by adding Section 5.559 to read as follows: |
|---|
| 13 | 14 | | Sec. 5.559. INTERNET WEBSITE POSTING OF APPLICATION. After |
|---|
| 14 | 15 | | an application has been determined to be administratively complete, |
|---|
| 15 | 16 | | the applicant or the commission shall: |
|---|
| 16 | 17 | | (1) post on a publicly accessible Internet website: |
|---|
| 17 | 18 | | (A) the application; and |
|---|
| 18 | 19 | | (B) any subsequent revision or supplement to the |
|---|
| 19 | 20 | | application as the revision or supplement becomes available; and |
|---|
| 20 | 21 | | (2) until the commission takes final action on the |
|---|
| 21 | 22 | | application: |
|---|
| 22 | 23 | | (A) maintain the posting on the Internet website; |
|---|
| 23 | 24 | | and |
|---|
| 24 | 25 | | (B) include the address of the Internet website |
|---|
| 25 | 26 | | in any public notice provided by the applicant or commission, |
|---|
| 26 | 27 | | including under Section 5.552 or 5.553. |

| 27 | 28 | | SECTION 2. Subchapter D, Chapter 11, Water Code, is amended |
|---|
| 28 | 29 | | by adding Section 11.159 to read as follows: |
|---|
| 29 | 30 | | Sec. 11.159. INTERNET WEBSITE POSTING OF APPLICATION. |

| 30 | 31 | | After an application has been determined to be administratively |
|---|
| 31 | 32 | | complete, the applicant or the commission shall: |

| 32 | 33 | | (1) post on a publicly accessible Internet website: |

|---|
| 34 | 35 | | materials required by this subchapter; and |
|---|

| 43 | 44 | | SECTION 3. The changes in law made by this Act apply only to |
|---|
| 44 | 45 | | an application received by the Texas Commission on Environmental |
|---|
| 45 | 46 | | Quality on or after the effective date of this Act. An application |
|---|
| 46 | 47 | | received before the effective date of this Act is governed by the |
|---|
| 47 | 48 | | law in effect on the date the application was received, and the |
|---|
| 48 | 49 | | former law is continued in effect for that purpose. |
|---|
| 49 | 50 | | SECTION 4. This Act takes effect September 1, 2021. |
