55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to programs that can be established and funded under the
88 Texas emissions reduction plan.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 386.051(b), Health and Safety Code, is
1111 amended to read as follows:
1212 (b) Under the plan, the commission and the comptroller shall
1313 provide grants or other funding for:
1414 (1) the diesel emissions reduction incentive program
1515 established under Subchapter C, including for infrastructure
1616 projects established under that subchapter;
1717 (2) the motor vehicle purchase or lease incentive
1818 program established under Subchapter D;
1919 (3) the air quality research support program
2020 established under Chapter 387;
2121 (4) the clean school bus program established under
2222 Chapter 390;
2323 (5) the new technology implementation grant program
2424 established under Chapter 391;
2525 (6) the regional air monitoring program established
2626 under Section 386.252(a);
2727 (7) a health effects study as provided by Section
2828 386.252(a);
2929 (8) air quality planning activities as provided by
3030 Section 386.252(d);
3131 (9) a contract with the Energy Systems Laboratory at
3232 the Texas A&M Engineering Experiment Station for computation of
3333 creditable statewide emissions reductions as provided by Section
3434 386.252(a);
3535 (10) the clean fleet program established under Chapter
3636 392;
3737 (11) the alternative fueling facilities program
3838 established under Chapter 393;
3939 (12) the natural gas vehicle grant program established
4040 under Chapter 394;
4141 (13) other programs the commission may develop that
4242 lead to reduced emissions of nitrogen oxides, particulate matter,
4343 or volatile organic compounds in a nonattainment area or affected
4444 county;
4545 (14) other programs the commission may develop that
4646 support congestion mitigation to reduce mobile source ozone
4747 precursor emissions;
4848 (15) the seaport and rail yard areas emissions
4949 reduction program established under Subchapter D-1;
5050 (16) conducting research and other activities
5151 associated with making any necessary demonstrations to the United
5252 States Environmental Protection Agency to account for the impact of
5353 foreign emissions or an exceptional event;
5454 (17) studies of or pilot programs for incentives for
5555 port authorities located in nonattainment areas or affected
5656 counties as provided by Section 386.252(a); [and]
5757 (18) the governmental alternative fuel fleet grant
5858 program established under Chapter 395; and
5959 (19) projects that reduce emissions through
6060 improvements in energy production efficiency using supercritical
6161 carbon dioxide.
6262 SECTION 2. Section 386.252(a), Health and Safety Code, as
6363 effective September 1, 2021, is amended to read as follows:
6464 (a) Money in the fund and account may be used only to
6565 implement and administer programs established under the plan.
6666 Subject to the reallocation of funds by the commission under
6767 Subsection (h), money from the fund and account to be used for the
6868 programs under Section 386.051(b) shall initially be allocated as
6969 follows:
7070 (1) four percent may be used for the clean school bus
7171 program under Chapter 390;
7272 (2) three percent may be used for the new technology
7373 implementation grant program under Chapter 391, from which at least
7474 $1 million will be set aside for electricity storage projects
7575 related to renewable energy;
7676 (3) five percent may be used for the clean fleet
7777 program under Chapter 392;
7878 (4) not more than $3 million may be used by the
7979 commission to fund a regional air monitoring program in commission
8080 Regions 3 and 4 to be implemented under the commission's oversight,
8181 including direction regarding the type, number, location, and
8282 operation of, and data validation practices for, monitors funded by
8383 the program through a regional nonprofit entity located in North
8484 Texas having representation from counties, municipalities, higher
8585 education institutions, and private sector interests across the
8686 area;
8787 (5) 10 percent may be used for the Texas natural gas
8888 vehicle grant program under Chapter 394;
8989 (6) not more than $6 million may be used for the Texas
9090 alternative fueling facilities program under Chapter 393, of which
9191 a specified amount may be used for fueling stations to provide
9292 natural gas fuel, except that money may not be allocated for the
9393 Texas alternative fueling facilities program for the state fiscal
9494 year ending August 31, 2019;
9595 (7) not more than $750,000 may be used each year to
9696 support research related to air quality as provided by Chapter 387;
9797 (8) not more than $200,000 may be used for a health
9898 effects study;
9999 (9) at least $6 million but not more than $16 million
100100 may be used by the commission for administrative costs, including
101101 all direct and indirect costs for administering the plan, costs for
102102 conducting outreach and education activities, and costs
103103 attributable to the review or approval of applications for
104104 marketable emissions reduction credits;
105105 (10) six percent may be used by the commission for the
106106 seaport and rail yard areas emissions reduction program established
107107 under Subchapter D-1;
108108 (11) five percent may be used for the light-duty motor
109109 vehicle purchase or lease incentive program established under
110110 Subchapter D;
111111 (12) not more than $216,000 may be used by the
112112 commission to contract with the Energy Systems Laboratory at the
113113 Texas A&M Engineering Experiment Station annually for the
114114 development and annual computation of creditable statewide
115115 emissions reductions obtained through wind and other renewable
116116 energy resources for the state implementation plan;
117117 (13) not more than $500,000 may be used for studies of
118118 or pilot programs for incentives for port authorities located in
119119 nonattainment areas or affected counties to encourage cargo
120120 movement that reduces emissions of nitrogen oxides and particulate
121121 matter; and
122122 (14) the balance is to be used by the commission for:
123123 (A) the diesel emissions reduction incentive
124124 program under Subchapter C as determined by the commission; and
125125 (B) projects that reduce emissions through
126126 improvements in energy production efficiency using supercritical
127127 carbon dioxide.
128128 SECTION 3. This Act takes effect September 1, 2021.
