55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the composition of the board of directors of the Fort
88 Bend Subsidence District, including a director's qualifications
99 and term.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 8834.051, Special District Local Laws
1212 Code, is amended by amending Subsections (a), (e), and (i) to read
1313 as follows:
1414 (a) The district is governed by a board of 16 [15] directors
1515 appointed as provided by this section.
1616 (e) The mayor of each of the following municipalities shall
1717 appoint a director from the mayor's respective municipality:
1818 (1) Houston;
1919 (2) Missouri City;
2020 (3) Stafford;
2121 (4) Sugar Land;
2222 (5) Rosenberg; [and]
2323 (6) Richmond; and
2424 (7) Fulshear.
2525 (i) The directors shall serve staggered terms as follows:
2626 (1) five members appointed under Subsection (e) and
2727 four members appointed under Subsection (f) shall serve terms
2828 expiring on January 1 of odd-numbered years; and
2929 (2) two members [one member] appointed under
3030 Subsection (e), two members appointed under Subsection (f), one
3131 member appointed under Subsection (g), and two members appointed
3232 under Subsection (h) shall serve terms expiring on January 1 of
3333 even-numbered years.
3434 SECTION 2. Not later than November 1, 2021, the mayor of the
3535 City of Fulshear shall appoint a member of the board of directors of
3636 the Fort Bend Subsidence District as provided by Section 8834.051,
3737 Special District Local Laws Code, as amended by this Act.
3838 SECTION 3. The Fort Bend Subsidence District retains all
3939 the rights, powers, privileges, authority, duties, and functions
4040 that it had before the effective date of this Act.
4141 SECTION 4. (a) The legal notice of the intention to
4242 introduce this Act, setting forth the general substance of this
4343 Act, has been published as provided by law, and the notice and a
4444 copy of this Act have been furnished to all persons, agencies,
4545 officials, or entities to which they are required to be furnished
4646 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
4747 Government Code.
4848 (b) The governor, one of the required recipients, has
4949 submitted the notice and Act to the Texas Commission on
5050 Environmental Quality.
5151 (c) The Texas Commission on Environmental Quality has filed
5252 its recommendations relating to this Act with the governor, the
5353 lieutenant governor, and the speaker of the house of
5454 representatives within the required time.
5555 (d) All requirements of the constitution and laws of this
5656 state and the rules and procedures of the legislature with respect
5757 to the notice, introduction, and passage of this Act are fulfilled
5858 and accomplished.
5959 SECTION 5. This Act takes effect immediately if it receives
6060 a vote of two-thirds of all the members elected to each house, as
6161 provided by Section 39, Article III, Texas Constitution. If this
6262 Act does not receive the vote necessary for immediate effect, this
6363 Act takes effect September 1, 2021.
