44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the composition of the districts for the election of
77 members of the State Board of Education.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. PURPOSE. The purpose of this Act is to fulfill
1010 the Legislature's responsibility to establish districts for the
1111 election of members of the State Board of Education following the
1212 publication of the 2020 census in compliance with the United States
1313 and Texas Constitutions and applicable Federal and state law.
1414 SECTION 2. FINDINGS. The Legislature finds:
1515 (1) Section 7.101, Education Code, requires the
1616 election of members of the board from districts;
1717 (2) As a result of the estimated rate of growth in the
1818 population of the state since 2011, the populations of the current
1919 districts for the election of members of the board are unequal and
2020 no longer comply with applicable legal requirements; and
2121 (3) The current districts must be replaced following
2222 publication of the decennial census with new districts that satisfy
2323 all applicable legal requirements.
2424 SECTION 3. COMPOSITION OF DISTRICTS. (a) The State of
2525 Texas is composed of 15 board of education districts as provided in
2626 this Act. Each district is composed of the counties or parts of
2727 counties as determined by the Legislature consistent with the
2828 requirements of the United States and Texas Constitutions and
2929 applicable Federal law.
3030 (b) One member of the board is elected from each district
3131 established by this Act.
3232 (c) For purposes of Section 7.104, Education Code, this Act
3333 constitutes a decennial reapportionment.
3434 SECTION 4. TRANSITION PROVISION. The districts established
3535 by this Act apply to the election of the members of the State Board
3636 of Education beginning with the primary and general elections in
3737 2022. This Act does not affect the membership or districts of the
3838 board before January 1, 2023.
3939 SECTION 5. REPEALER. Chapter 72 (H.B. 600), Acts of the
4040 82nd Legislature, Regular Session, 2011, is repealed.
4141 SECTION 6. EFFECTIVE DATE. This Act takes effect
4242 immediately if it receives a vote of two-thirds of all the members
4343 elected to each house, as provided by Section 39, Article III, Texas
4444 Constitution. If this Act does not receive the vote necessary for
4545 immediate effect, this Act takes effect September 1, 2021.
