6 | 6 | | relating to the composition of the districts for the election of |
---|
7 | 7 | | members of the State Board of Education. |
---|
8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. PURPOSE. The purpose of this Act is to fulfill |
---|
10 | 10 | | the Legislature's responsibility to establish districts for the |
---|
11 | 11 | | election of members of the State Board of Education following the |
---|
12 | 12 | | publication of the 2020 census in compliance with the United States |
---|
13 | 13 | | and Texas Constitutions and applicable Federal and state law. |
---|
14 | 14 | | SECTION 2. FINDINGS. The Legislature finds: |
---|
15 | 15 | | (1) Section 7.101, Education Code, requires the |
---|
16 | 16 | | election of members of the board from districts; |
---|
17 | 17 | | (2) As a result of the estimated rate of growth in the |
---|
18 | 18 | | population of the state since 2011, the populations of the current |
---|
19 | 19 | | districts for the election of members of the board are unequal and |
---|
20 | 20 | | no longer comply with applicable legal requirements; and |
---|
21 | 21 | | (3) The current districts must be replaced following |
---|
22 | 22 | | publication of the decennial census with new districts that satisfy |
---|
23 | 23 | | all applicable legal requirements. |
---|
24 | 24 | | SECTION 3. COMPOSITION OF DISTRICTS. (a) The State of |
---|
25 | 25 | | Texas is composed of 15 board of education districts as provided in |
---|
26 | 26 | | this Act. Each district is composed of the counties or parts of |
---|
27 | 27 | | counties as determined by the Legislature consistent with the |
---|
28 | 28 | | requirements of the United States and Texas Constitutions and |
---|
29 | 29 | | applicable Federal law. |
---|
30 | 30 | | (b) One member of the board is elected from each district |
---|
31 | 31 | | established by this Act. |
---|
32 | 32 | | (c) For purposes of Section 7.104, Education Code, this Act |
---|
33 | 33 | | constitutes a decennial reapportionment. |
---|
34 | 34 | | SECTION 4. TRANSITION PROVISION. The districts established |
---|
35 | 35 | | by this Act apply to the election of the members of the State Board |
---|
36 | 36 | | of Education beginning with the primary and general elections in |
---|
37 | 37 | | 2022. This Act does not affect the membership or districts of the |
---|
38 | 38 | | board before January 1, 2023. |
---|
39 | 39 | | SECTION 5. REPEALER. Chapter 72 (H.B. 600), Acts of the |
---|
40 | 40 | | 82nd Legislature, Regular Session, 2011, is repealed. |
---|
41 | 41 | | SECTION 6. EFFECTIVE DATE. This Act takes effect |
---|
42 | 42 | | immediately if it receives a vote of two-thirds of all the members |
---|
43 | 43 | | elected to each house, as provided by Section 39, Article III, Texas |
---|
44 | 44 | | Constitution. If this Act does not receive the vote necessary for |
---|
45 | 45 | | immediate effect, this Act takes effect September 1, 2021. |
