77 relating to information regarding breast-feeding.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter A, Chapter 165, Health and Safety
1010 Code, is amended by adding Section 165.005 to read as follows:
1111 Sec. 165.005. INFORMATION REGARDING BREAST-FEEDING. (a)
1212 In this section:
1313 (1) "Birthing center" means a facility licensed under
1414 Chapter 244.
1515 (2) "Hospital" means a facility licensed under Chapter
1616 241 or a hospital maintained or operated by this state.
1717 (b) A hospital or birthing center shall provide as
1818 appropriate and at no cost to each mother who gives birth at the
1919 hospital or center information regarding breast-feeding that
2020 includes:
2121 (1) a mother's right to breast-feed as described by
2222 Section 165.002 and as applicable to express breast milk at the
2323 mother's public employer workplace as described by Chapter 619,
2424 Government Code;
2525 (2) the nutritional, medical, and emotional benefits
2626 of breast-feeding for the mother and the child;
2727 (3) common breast-feeding problems and solutions to
2828 those problems; and
2929 (4) preparation of the mother and the child for
3030 breast-feeding.
3131 (c) The commission shall make the information described by
3232 Subsection (b) available on the commission's Internet website in a
3333 format that may be easily printed. The commission may provide the
3434 information described by Subsection (b) in writing to hospitals and
3535 birthing centers if the commission determines that providing
3636 written information is cost-effective.
3737 SECTION 2. This Act takes effect September 1, 2021.
