| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter A, Chapter 165, Health and Safety |
|---|
| 10 | 10 | | Code, is amended by adding Section 165.005 to read as follows: |
|---|
| 11 | 11 | | Sec. 165.005. INFORMATION REGARDING BREAST-FEEDING. (a) |
|---|
| 12 | 12 | | In this section: |
|---|
| 13 | 13 | | (1) "Birthing center" means a facility licensed under |
|---|
| 14 | 14 | | Chapter 244. |
|---|
| 15 | 15 | | (2) "Hospital" means a facility licensed under Chapter |
|---|
| 16 | 16 | | 241 or a hospital maintained or operated by this state. |
|---|
| 17 | 17 | | (b) A hospital or birthing center shall provide as |
|---|
| 18 | 18 | | appropriate and at no cost to each mother who gives birth at the |
|---|
| 19 | 19 | | hospital or center information regarding breast-feeding that |
|---|
| 20 | 20 | | includes: |
|---|
| 21 | 21 | | (1) a mother's right to breast-feed as described by |
|---|
| 22 | 22 | | Section 165.002 and as applicable to express breast milk at the |
|---|
| 23 | 23 | | mother's public employer workplace as described by Chapter 619, |
|---|
| 24 | 24 | | Government Code; |
|---|
| 25 | 25 | | (2) the nutritional, medical, and emotional benefits |
|---|
| 26 | 26 | | of breast-feeding for the mother and the child; |
|---|
| 27 | 27 | | (3) common breast-feeding problems and solutions to |
|---|
| 28 | 28 | | those problems; and |
|---|
| 29 | 29 | | (4) preparation of the mother and the child for |
|---|
| 30 | 30 | | breast-feeding. |
|---|
| 31 | 31 | | (c) The commission shall make the information described by |
|---|
| 32 | 32 | | Subsection (b) available on the commission's Internet website in a |
|---|
| 33 | 33 | | format that may be easily printed. The commission may provide the |
|---|
| 34 | 34 | | information described by Subsection (b) in writing to hospitals and |
|---|
| 35 | 35 | | birthing centers if the commission determines that providing |
|---|
| 36 | 36 | | written information is cost-effective. |
|---|
| 37 | 37 | | SECTION 2. This Act takes effect September 1, 2021. |
