55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to annulment of a marriage on the grounds of fraud, duress,
88 or force.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 6.107, Family Code, is amended to read as
1111 follows:
1212 Sec. 6.107. FRAUD, DURESS, OR FORCE. The court may grant an
1313 annulment of a marriage to a party to the marriage if:
1414 (1) the other party used fraud, duress, or force to
1515 induce the petitioner to enter into the marriage; and
1616 (2) the petitioner ceased cohabitation with the other
1717 party not more than one year after the petitioner learned of the
1818 fraud or was released from the duress or force and has not
1919 voluntarily cohabited with the other party since ceasing
2020 cohabitation [learning of the fraud or since being released from
2121 the duress or force].
2222 SECTION 2. The change in law made by this Act applies only
2323 to a suit for dissolution of a marriage that is filed on or after the
2424 effective date of this Act. A suit for dissolution of a marriage
2525 filed before the effective date of this Act is governed by the law
2626 in effect on the date the suit was filed, and the former law is
2727 continued in effect for that purpose.
2828 SECTION 3. This Act takes effect September 1, 2021.
