| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 6.107, Family Code, is amended to read as | |
| 11 | 11 | follows: | |
| 12 | 12 | Sec. 6.107. FRAUD, DURESS, OR FORCE. The court may grant an | |
| 13 | 13 | annulment of a marriage to a party to the marriage if: | |
| 14 | 14 | (1) the other party used fraud, duress, or force to | |
| 15 | 15 | induce the petitioner to enter into the marriage; and | |
| 16 | 16 | (2) the petitioner ceased cohabitation with the other | |
| 17 | 17 | party not more than one year after the petitioner learned of the | |
| 18 | 18 | fraud or was released from the duress or force and has not | |
| 19 | 19 | voluntarily cohabited with the other party since ceasing | |
| 20 | 20 | cohabitation [learning of the fraud or since being released from | |
| 21 | 21 | the duress or force]. | |
| 22 | 22 | SECTION 2. The change in law made by this Act applies only | |
| 23 | 23 | to a suit for dissolution of a marriage that is filed on or after the | |
| 24 | 24 | effective date of this Act. A suit for dissolution of a marriage | |
| 25 | 25 | filed before the effective date of this Act is governed by the law | |
| 26 | 26 | in effect on the date the suit was filed, and the former law is | |
| 27 | 27 | continued in effect for that purpose. | |
| 28 | 28 | SECTION 3. This Act takes effect September 1, 2021. |
