8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 6.106, Family Code, is amended to read as | |
10 | 10 | follows: | |
11 | 11 | Sec. 6.106. IMPOTENCY. The court may grant an annulment of | |
12 | 12 | a marriage to a party to the marriage if: | |
13 | 13 | (1) either party, for physical or mental reasons, was | |
14 | 14 | permanently impotent at the time of the marriage; | |
15 | 15 | (2) the petitioner did not know of the impotency at the | |
16 | 16 | time of the marriage; and | |
17 | 17 | (3) the petitioner ceased cohabitation with the other | |
18 | 18 | party not more than one year after the petitioner learned of the | |
19 | 19 | impotency and has not voluntarily cohabited with the other party | |
20 | 20 | since ceasing cohabitation [learning of the impotency]. | |
21 | 21 | SECTION 2. The change in law made by this Act applies only | |
22 | 22 | to a suit for dissolution of a marriage that is filed on or after the | |
23 | 23 | effective date of this Act. A suit for dissolution of a marriage | |
24 | 24 | filed before the effective date of this Act is governed by the law | |
25 | 25 | in effect on the date the suit was filed, and the former law is | |
26 | 26 | continued in effect for that purpose. | |
27 | 27 | SECTION 3. This Act takes effect September 1, 2021. |
