66 AN ACT
77 relating to the membership and meetings of the Public Utility
88 Commission of Texas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 12.051(a) and (b), Utilities Code, are
1111 amended to read as follows:
1212 (a) The commission is composed of:
1313 (1) three commissioners appointed by the governor with
1414 the advice and consent of the senate;
1515 (2) one commissioner appointed by the governor from a
1616 list of names submitted by the speaker of the house of
1717 representatives and with the advice and consent of the senate; and
1818 (3) one commissioner appointed by the lieutenant
1919 governor with the advice and consent of the senate.
2020 (b) An appointment to the commission shall be made without
2121 regard to the race, color, disability, sex, religion, age, or
2222 national origin of the appointee. The appointments shall be made so
2323 that at least one commissioner is designated to represent each of
2424 the north, south, west, and Houston load zones of the ERCOT power
2525 region. One commissioner may serve without having a designated
2626 zone.
2727 SECTION 2. Section 12.055, Utilities Code, is amended to
2828 read as follows:
2929 Sec. 12.055. PROHIBITION ON SEEKING ANOTHER OFFICE. A
3030 person may not seek nomination or election to another civil office
3131 of this state or of the United States while serving as a
3232 commissioner. If a commissioner files for nomination or election
3333 to another civil office of this state or of the United States, the
3434 person's office as commissioner immediately becomes vacant, and the
3535 governor or lieutenant governor, as applicable, shall appoint a
3636 successor in accordance with Section 12.051 and, if necessary,
3737 shall designate the zone to be represented by the commissioner in
3838 accordance with Subsection (b) of that section.
3939 SECTION 3. Section 12.058, Utilities Code, is amended to
4040 read as follows:
4141 Sec. 12.058. MEETINGS. The commission shall hold meetings
4242 at its office and at other convenient places in this state on the
4343 first and third Thursday of every month [as expedient and
4444 necessary] for the proper performance of the commission's duties.
4545 SECTION 4. (a) The governor and the lieutenant governor
4646 each shall promptly appoint a commissioner to the Public Utility
4747 Commission of Texas in accordance with Sections 12.051(a)(2) and
4848 (3), Utilities Code, as added by this Act. The term of the
4949 commissioner appointed by the lieutenant governor expires
5050 September 1, 2025, and the term of the commissioner appointed by the
5151 governor expires September 1, 2027. The appointments made under
5252 this section must designate the appointed commissioner as
5353 representing a zone described by Section 12.051(b), Utilities Code,
5454 as amended by this Act.
5555 (b) Following the appointments made under Subsection (a) of
5656 this section, the governor shall designate two of the other three
5757 commissioners of the Public Utility Commission of Texas as a
5858 commissioner representing one of the zones described by Section
5959 12.051(b), Utilities Code, as amended by this Act.
6060 SECTION 5. This Act takes effect September 1, 2021.
