9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Sections 12.051(a) and (b), Utilities Code, are |
---|
11 | 11 | | amended to read as follows: |
---|
12 | 12 | | (a) The commission is composed of: |
---|
13 | 13 | | (1) three commissioners appointed by the governor with |
---|
14 | 14 | | the advice and consent of the senate; |
---|
15 | 15 | | (2) one commissioner appointed by the governor from a |
---|
16 | 16 | | list of names submitted by the speaker of the house of |
---|
17 | 17 | | representatives and with the advice and consent of the senate; and |
---|
18 | 18 | | (3) one commissioner appointed by the lieutenant |
---|
19 | 19 | | governor with the advice and consent of the senate. |
---|
20 | 20 | | (b) An appointment to the commission shall be made without |
---|
21 | 21 | | regard to the race, color, disability, sex, religion, age, or |
---|
22 | 22 | | national origin of the appointee. The appointments shall be made so |
---|
23 | 23 | | that at least one commissioner is designated to represent each of |
---|
24 | 24 | | the north, south, west, and Houston load zones of the ERCOT power |
---|
25 | 25 | | region. One commissioner may serve without having a designated |
---|
26 | 26 | | zone. |
---|
27 | 27 | | SECTION 2. Section 12.055, Utilities Code, is amended to |
---|
28 | 28 | | read as follows: |
---|
29 | 29 | | Sec. 12.055. PROHIBITION ON SEEKING ANOTHER OFFICE. A |
---|
30 | 30 | | person may not seek nomination or election to another civil office |
---|
31 | 31 | | of this state or of the United States while serving as a |
---|
32 | 32 | | commissioner. If a commissioner files for nomination or election |
---|
33 | 33 | | to another civil office of this state or of the United States, the |
---|
34 | 34 | | person's office as commissioner immediately becomes vacant, and the |
---|
35 | 35 | | governor or lieutenant governor, as applicable, shall appoint a |
---|
36 | 36 | | successor in accordance with Section 12.051 and, if necessary, |
---|
37 | 37 | | shall designate the zone to be represented by the commissioner in |
---|
38 | 38 | | accordance with Subsection (b) of that section. |
---|
39 | 39 | | SECTION 3. Section 12.058, Utilities Code, is amended to |
---|
40 | 40 | | read as follows: |
---|
41 | 41 | | Sec. 12.058. MEETINGS. The commission shall hold meetings |
---|
42 | 42 | | at its office and at other convenient places in this state on the |
---|
43 | 43 | | first and third Thursday of every month [as expedient and |
---|
44 | 44 | | necessary] for the proper performance of the commission's duties. |
---|
45 | 45 | | SECTION 4. (a) The governor and the lieutenant governor |
---|
46 | 46 | | each shall promptly appoint a commissioner to the Public Utility |
---|
47 | 47 | | Commission of Texas in accordance with Sections 12.051(a)(2) and |
---|
48 | 48 | | (3), Utilities Code, as added by this Act. The term of the |
---|
49 | 49 | | commissioner appointed by the lieutenant governor expires |
---|
50 | 50 | | September 1, 2025, and the term of the commissioner appointed by the |
---|
51 | 51 | | governor expires September 1, 2027. The appointments made under |
---|
52 | 52 | | this section must designate the appointed commissioner as |
---|
53 | 53 | | representing a zone described by Section 12.051(b), Utilities Code, |
---|
54 | 54 | | as amended by this Act. |
---|
55 | 55 | | (b) Following the appointments made under Subsection (a) of |
---|
56 | 56 | | this section, the governor shall designate two of the other three |
---|
57 | 57 | | commissioners of the Public Utility Commission of Texas as a |
---|
58 | 58 | | commissioner representing one of the zones described by Section |
---|
59 | 59 | | 12.051(b), Utilities Code, as amended by this Act. |
---|
60 | 60 | | SECTION 5. This Act takes effect September 1, 2021. |
