9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Sections 311.0025(a) and (b), Health and Safety | |
11 | 11 | Code, are amended to read as follows: | |
12 | 12 | (a) A hospital, treatment facility, mental health facility, | |
13 | 13 | or health care professional may not: | |
14 | 14 | (1) flagrantly overcharge a patient or third party | |
15 | 15 | payor for a treatment provided to the patient; or | |
16 | 16 | (2) submit to a patient or a third party payor a bill | |
17 | 17 | for a treatment that the hospital, facility, or professional knows | |
18 | 18 | was not provided or knows was improper, unreasonable, or medically | |
19 | 19 | or clinically unnecessary. | |
20 | 20 | (b) If the appropriate licensing agency receives a | |
21 | 21 | complaint alleging a violation of Subsection (a)(2) [(a)], the | |
22 | 22 | agency may audit the billings and patient records of the hospital, | |
23 | 23 | treatment facility, mental health facility, or health care | |
24 | 24 | professional. | |
25 | 25 | SECTION 2. This Act takes effect September 1, 2021. |
