66 AN ACT
77 relating to prohibited billing practices by certain health care
88 providers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 311.0025(a) and (b), Health and Safety
1111 Code, are amended to read as follows:
1212 (a) A hospital, treatment facility, mental health facility,
1313 or health care professional may not:
1414 (1) flagrantly overcharge a patient or third party
1515 payor for a treatment provided to the patient; or
1616 (2) submit to a patient or a third party payor a bill
1717 for a treatment that the hospital, facility, or professional knows
1818 was not provided or knows was improper, unreasonable, or medically
1919 or clinically unnecessary.
2020 (b) If the appropriate licensing agency receives a
2121 complaint alleging a violation of Subsection (a)(2) [(a)], the
2222 agency may audit the billings and patient records of the hospital,
2323 treatment facility, mental health facility, or health care
2424 professional.
2525 SECTION 2. This Act takes effect September 1, 2021.
