| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 48.009(b), Education Code, is amended to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | (b) The commissioner by rule shall require each school |
|---|
| 15 | 15 | | district and open-enrollment charter school to report through the |
|---|
| 16 | 16 | | Public Education Information Management System information |
|---|
| 17 | 17 | | regarding: |
|---|
| 18 | 18 | | (1) the number of students enrolled in the district or |
|---|
| 19 | 19 | | school who are identified as having dyslexia; |
|---|
| 20 | 20 | | (2) the availability of school counselors, including |
|---|
| 21 | 21 | | the number of full-time equivalent school counselors, at each |
|---|
| 22 | 22 | | campus; |
|---|
| 23 | 23 | | (3) the availability of expanded learning |
|---|
| 24 | 24 | | opportunities as described by Section 33.252 at each campus; |
|---|
| 25 | 25 | | (4) the total number of students, other than students |
|---|
| 26 | 26 | | described by Subdivision (5), enrolled in the district or school |
|---|
| 27 | 27 | | with whom the district or school, as applicable, used intervention |
|---|
| 28 | 28 | | strategies, as that term is defined by Section 26.004, at any time |
|---|
| 29 | 29 | | during the year for which the report is made; [and] |
|---|
| 30 | 30 | | (5) the total number of students enrolled in the |
|---|
| 31 | 31 | | district or school to whom the district or school provided aids, |
|---|
| 32 | 32 | | accommodations, or services under Section 504, Rehabilitation Act |
|---|
| 33 | 33 | | of 1973 (29 U.S.C. Section 794), at any time during the year for |
|---|
| 34 | 34 | | which the report is made; and |
|---|
| 35 | 35 | | (6) the total number of students, including the |
|---|
| 36 | 36 | | students' age, race, and gender, transported from the school |
|---|
| 37 | 37 | | district or open-enrollment charter school for an emergency |
|---|
| 38 | 38 | | detention under Chapter 573, Health and Safety Code, at any time |
|---|
| 39 | 39 | | during the year for which the report is made. |
|---|
| 40 | 40 | | SECTION 2. This Act applies beginning with 2021-2022 school |
|---|
| 41 | 41 | | year. |
|---|
| 42 | 42 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 43 | 43 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 44 | 44 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 45 | 45 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 46 | 46 | | Act takes effect September 1, 2021. |
