811 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9- SECTION 1. (a) In this section, "council" means the Texas
10- Interagency Council for the Homeless established under Subchapter
11- KK, Chapter 2306, Government Code.
12- (b) The council shall conduct a study on the feasibility of
13- establishing a statewide homelessness data system through which:

13+ amended by adding Section 2306.911 to read as follows:
14+ Sec. 2306.911. STATEWIDE HOMELESSNESS DATA SYSTEM. (a)
15+ The council shall collaborate with a state agency designated by the
16+ council to establish a statewide homelessness data system through
17+ which:
1418 (1) state agencies and local governmental entities,
1519 including law enforcement agencies, court systems, school
1620 districts, and emergency service providers, are able to share
1721 information related to individuals experiencing homelessness; and
18- (2) the entities described by Subdivision (1) of this
19- subsection are able to access information related to individuals
20- experiencing homelessness in order to connect or refer those
21- individuals to services, including affordable housing
22- opportunities.
23- (c) In conducting the study under this section, the council
24- shall:

26+ (b) In developing the data system, the council and the state

27- challenges faced by those entities in addressing homelessness and
28- how best to improve the responses to those challenges; and
29- (2) assess the feasibility for the statewide
30- homelessness data system described by Subsection (b) of this
31- section to:
32- (A) ensure that information stored in the data
33- system that is confidential under state or federal law is not
34- disclosed;
35- (B) collect data from other homelessness data
36- systems maintained or operated by a state agency, local law
37- enforcement agency, or other entity of this state; and
38- (C) collect, aggregate, analyze, and share
39- homelessness information with entities that have access to the
40- system.
41- (d) Not later than October 1, 2022, the council shall
42- prepare and submit to the legislature and the Texas Department of
43- Housing and Community Affairs a written report that summarizes the
44- results of the study conducted under this section.
45- SECTION 2. This Act expires September 1, 2023.

33+ for the exchange of information relating to individuals

37+ (c) The data system established under this section must:
38+ (1) to the extent permitted by a data sharing
39+ agreement, collect data from other homelessness data systems
40+ maintained or operated by a state agency, local law enforcement
41+ agency, or other entity of this state; and
42+ (2) collect, aggregate, analyze, and share
43+ homelessness information submitted to the data system with entities
44+ that have access to the system.
45+ SECTION 2. Not later than September 1, 2023, the Texas
46+ Interagency Council for the Homeless described by Subchapter KK,
47+ Chapter 2306, Government Code, or an entity designated by the
48+ council shall prepare and submit to the legislature and the Texas
49+ Department of Housing and Community Affairs a written report that
50+ evaluates the effectiveness of the statewide homelessness data
51+ system established under Section 2306.911, Government Code, as
52+ added by this Act, in addressing homelessness in this state.
4653 SECTION 3. This Act takes effect September 1, 2021.
