9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 24, Property Code, is amended by adding | |
11 | 11 | Section 24.012 to read as follows: | |
12 | 12 | Sec. 24.012. TEMPORARY ABATEMENT OF EVICTION DURING AND | |
13 | 13 | AFTER DISASTER. (a) In this section, "state of disaster" means a | |
14 | 14 | state of disaster declared by the governor under Section 418.014, | |
15 | 15 | Government Code. | |
16 | 16 | (b) This section applies only to an eviction based on a | |
17 | 17 | tenant's nonpayment of rent. | |
18 | 18 | (c) An action under this chapter to evict a tenant is | |
19 | 19 | automatically abated without a court order during the period a | |
20 | 20 | state of disaster is in effect and until the 61st day after the date | |
21 | 21 | a state of disaster ends. | |
22 | 22 | (d) During the period a state of disaster is in effect and | |
23 | 23 | until the 61st day after the date a state of disaster ends, an | |
24 | 24 | officer may not execute a writ of possession relating to the | |
25 | 25 | eviction of a tenant. | |
26 | 26 | SECTION 2. This Act takes effect September 1, 2021. |
