66 AN ACT
77 relating to deployment of information technology and electric
88 distribution system upgrades to more equitably distribute rolling
99 blackouts.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 38, Utilities Code, is amended by adding
1212 Subchapter F to read as follows:
1313 SUBCHAPTER F. UPGRADES FOR ROLLING BLACKOUTS
1414 Sec. 38.151. ADVANCED METER DEPLOYMENT. (a) Each
1515 transmission and distribution utility, municipally owned utility,
1616 and electric cooperative shall install and connect to an
1717 information network, for each customer, an advanced meter capable
1818 of allowing the utility or cooperative to shut off the customer's
1919 power when a rolling blackout is necessary.
2020 (b) Notwithstanding any other law, a customer may not refuse
2121 installation and connection of an advanced meter under this
2222 section.
2323 Sec. 38.152. ADVANCED METERING EQUIPMENT AND SOFTWARE. (a)
2424 A transmission and distribution utility, municipally owned
2525 utility, or electric cooperative shall develop or acquire the
2626 equipment and software necessary to shut off a customer's power in
2727 the event of a rolling blackout by using an advanced meter installed
2828 and connected under Section 38.151.
2929 (b) A utility or cooperative shall make software described
3030 by Subsection (a) available to:
3131 (1) a county or municipal government, for the purpose
3232 of identifying critical load public safety customers; and
3333 (2) a retail electric provider, for the purpose of
3434 providing the utility or cooperative with a preferential order for
3535 customer curtailment.
3636 Sec. 38.153. UPGRADES TO DISTRIBUTION SYSTEM. (a) Each
3737 transmission and distribution utility, municipally owned utility,
3838 or electric cooperative shall make upgrades to the distribution
3939 system operated by the utility or cooperative for the purpose of
4040 more evenly distributing a rolling blackout.
4141 (b) Upgrades made under Subsection (a) may include the
4242 installation of additional under-frequency relays or energy
4343 storage systems, if permitted.
4444 (c) Each transmission and distribution utility, municipally
4545 owned utility, or electric cooperative shall install
4646 under-frequency relays throughout the distribution system operated
4747 by the utility or cooperative and rotate which relays are active
4848 every year.
4949 Sec. 38.154. COST RECOVERY. A transmission and
5050 distribution utility, municipally owned utility, or electric
5151 cooperative may recover reasonable and necessary costs incurred in
5252 deploying advanced meters under Section 38.151, developing or
5353 acquiring equipment and software under Section 38.152, or making
5454 upgrades to the distribution system operated by the utility or
5555 cooperative under Section 38.153.
5656 Sec. 38.155. ROLLING BLACKOUT PLAN. (a) Each utility or
5757 cooperative shall make a plan for using advanced metering
5858 technology, software, equipment, and other upgrades to a
5959 distribution system authorized by this subchapter to deploy a
6060 rolling blackout.
6161 (b) A plan developed under Subsection (a) may include use of
6262 both advanced metering technology and distribution feeders.
6363 Sec. 38.156. CRITICAL LOAD DESIGNATION. (a) A critical
6464 load public safety customer, as defined by commission rules,
6565 includes the following:
6666 (1) long-term care facilities;
6767 (2) food pantries;
6868 (3) homeless shelters
6969 (4) temporary shelters identified by the county
7070 government; and
7171 (5) critical telecommunications facilities.
7272 (b) The commission shall allow a county to designate a
7373 critical load public safety customer.
7474 (c) A transmission and distribution utility, municipally
7575 owned utility, or electric cooperative shall identify customers in
7676 the utility's or cooperative's service area who qualify as critical
7777 load public safety customers under commission rules and are not
7878 designated as critical load public safety customers.
7979 (d) A utility or cooperative shall notify the following
8080 entities of any critical load public safety customers identified
8181 under Subsection (c):
8282 (1) the commission;
8383 (2) the independent system operator certified under
8484 Section 39.151 for the ERCOT power region, if applicable; and
8585 (3) a county or municipality where the customer
8686 resides.
8787 SECTION 2. (a) In this section, the term "transmission and
8888 distribution utility" has the meaning assigned by Section 31.002,
8989 Utilities Code.
9090 (b) Not later than September 1, 2022, the Public Utility
9191 Commission of Texas shall identify the best methods for
9292 implementing Subchapter F, Chapter 38, Utilities Code, as added by
9393 this Act, and adopt rules as necessary to reflect those methods and
9494 implement the subchapter.
9595 (c) A transmission and distribution utility, municipally
9696 owned utility, or electric cooperative shall implement Sections
9797 38.152, 38.153, 38.155, and 38.156, Utilities Code, as added by
9898 this Act, not later than September 1, 2025, if the utility or
9999 cooperative has installed and connected an advanced meter for each
100100 customer before September 1, 2022, that:
101101 (1) is capable of allowing the utility or cooperative
102102 to shut off the customer's power when a rolling blackout is
103103 necessary; and
104104 (2) meets standards established by commission rules
105105 adopted under Subsection (b) of this section.
106106 (d) A transmission and distribution utility, municipally
107107 owned utility, or electric cooperative shall implement Sections
108108 38.152, 38.153, 38.155, and 38.156, Utilities Code, as added by
109109 this Act, not later than September 1, 2026, if the utility or
110110 cooperative has not installed and connected an advanced meter for
111111 each customer before September 1, 2022, that:
112112 (1) is capable of allowing the utility or cooperative
113113 to shut off the customer's power when a rolling blackout is
114114 necessary; and
115115 (2) meets standards established by commission rules
116116 adopted under Subsection (b) of this section.
117117 (e) The Public Utility Commission of Texas may extend the
118118 deadlines under Subsections (c) and (d) of this section by not more
119119 than one year, on a case-by-case basis.
120120 SECTION 3. This Act takes effect September 1, 2021.
