| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 313.007, Tax Code, is amended to read as |
|---|
| 11 | 11 | | follows: |
|---|
| 12 | 12 | | Sec. 313.007. EXPIRATION. Subchapters B and C expire |
|---|
| 13 | 13 | | December 31, 2032 [2022]. |
|---|
| 14 | 14 | | SECTION 2. Section 313.024(b), Tax Code, is amended to read |
|---|
| 15 | 15 | | as follows: |
|---|
| 16 | 16 | | (b) To be eligible for a limitation on appraised value under |
|---|
| 17 | 17 | | this subchapter, the entity must use the property for: |
|---|
| 18 | 18 | | (1) manufacturing; |
|---|
| 19 | 19 | | (2) research and development; |
|---|
| 20 | 20 | | (3) a clean coal project, as defined by Section 5.001, |
|---|
| 21 | 21 | | Water Code; |
|---|
| 22 | 22 | | (4) an advanced clean energy project, as defined by |
|---|
| 23 | 23 | | Section 382.003, Health and Safety Code; |
|---|
| 24 | 24 | | (5) renewable energy electric generation; |
|---|
| 25 | 25 | | (6) electric power generation using integrated |
|---|
| 26 | 26 | | gasification combined cycle technology; |
|---|
| 27 | 27 | | (7) nuclear electric power generation; |
|---|
| 28 | 28 | | (8) a computer center primarily used in connection |
|---|
| 29 | 29 | | with one or more activities described by Subdivisions (1) through |
|---|
| 30 | 30 | | (7) conducted by the entity; [or] |
|---|
| 31 | 31 | | (9) a Texas priority project; |
|---|
| 32 | 32 | | (10) an aquifer storage and recovery project; |
|---|
| 33 | 33 | | (11) a seawater desalination project; |
|---|
| 34 | 34 | | (12) a project to treat fluid oil and gas waste for a |
|---|
| 35 | 35 | | subsequent beneficial use; or |
|---|
| 36 | 36 | | (13) an interregional water supply project. |
|---|
| 37 | 37 | | SECTION 3. Section 313.024(e), Tax Code, is amended by |
|---|
| 38 | 38 | | adding Subdivisions (10), (11), (12), and (13) to read as follows: |
|---|
| 39 | 39 | | (10) "Aquifer storage and recovery project" has the |
|---|
| 40 | 40 | | meaning assigned by Section 27.151, Water Code. |
|---|
| 41 | 41 | | (11) "Seawater desalination project" means a project |
|---|
| 42 | 42 | | to divert state water from the Gulf of Mexico or a bay or arm of the |
|---|
| 43 | 43 | | Gulf of Mexico for desalination and use for industrial purposes. |
|---|
| 44 | 44 | | (12) "Fluid oil and gas waste" has the meaning |
|---|
| 45 | 45 | | assigned by Section 122.001, Natural Resources Code. |
|---|
| 46 | 46 | | (13) "Interregional water supply project" means a |
|---|
| 47 | 47 | | water supply project that benefits multiple water planning regions. |
|---|
| 48 | 48 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 49 | 49 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 50 | 50 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 51 | 51 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 52 | 52 | | Act takes effect September 1, 2021. |
