| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 43.02, Penal Code, is amended by adding | |
| 11 | 11 | Subsection (b-1) to read as follows: | |
| 12 | 12 | (b-1) A person may not be prosecuted for an offense under | |
| 13 | 13 | Subsection (a) that the person committed when younger than 17 years | |
| 14 | 14 | of age. | |
| 15 | 15 | SECTION 2. This Act applies only to an offense committed or | |
| 16 | 16 | conduct that occurs on or after the effective date of this Act. An | |
| 17 | 17 | offense committed or conduct that occurs before the effective date | |
| 18 | 18 | of this Act is governed by the law in effect on the date the offense | |
| 19 | 19 | was committed or the conduct occurred, and the former law is | |
| 20 | 20 | continued in effect for that purpose. For the purposes of this | |
| 21 | 21 | section, an offense was committed or conduct occurred before the | |
| 22 | 22 | effective date of this Act if any element of the offense or conduct | |
| 23 | 23 | occurred before that date. | |
| 24 | 24 | SECTION 3. This Act takes effect September 1, 2021. |
