66 AN ACT
77 relating to unemployment compensation chargebacks regarding
88 certain persons employed as seasonal employees.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 204.022, Labor Code, is amended by
1111 adding Subsection (a-3) to read as follows:
1212 (a-3) Benefits computed on benefit wage credits of a
1313 seasonal employee or former seasonal employee may not be charged to
1414 the account of an employer if at least 75 percent of the employees
1515 employed by the employer during each of the most recent three
1616 calendar years were employed as seasonal employees. In this
1717 subsection, "seasonal employee" means an employee who, as a regular
1818 course of the employee's conduct, engages in seasonal or cyclical
1919 employment that does not continue throughout the entire year.
2020 SECTION 2. The change in law made by this Act applies only
2121 to a claim for unemployment compensation benefits filed with the
2222 Texas Workforce Commission on or after the effective date of this
2323 Act. A claim filed before the effective date of this Act is
2424 governed by the law in effect on the date the claim was filed, and
2525 the former law is continued in effect for that purpose.
2626 SECTION 3. This Act takes effect October 1, 2021.
