9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 204.022, Labor Code, is amended by | |
11 | 11 | adding Subsection (a-3) to read as follows: | |
12 | 12 | (a-3) Benefits computed on benefit wage credits of a | |
13 | 13 | seasonal employee or former seasonal employee may not be charged to | |
14 | 14 | the account of an employer if at least 75 percent of the employees | |
15 | 15 | employed by the employer during each of the most recent three | |
16 | 16 | calendar years were employed as seasonal employees. In this | |
17 | 17 | subsection, "seasonal employee" means an employee who, as a regular | |
18 | 18 | course of the employee's conduct, engages in seasonal or cyclical | |
19 | 19 | employment that does not continue throughout the entire year. | |
20 | 20 | SECTION 2. The change in law made by this Act applies only | |
21 | 21 | to a claim for unemployment compensation benefits filed with the | |
22 | 22 | Texas Workforce Commission on or after the effective date of this | |
23 | 23 | Act. A claim filed before the effective date of this Act is | |
24 | 24 | governed by the law in effect on the date the claim was filed, and | |
25 | 25 | the former law is continued in effect for that purpose. | |
26 | 26 | SECTION 3. This Act takes effect October 1, 2021. |
