79 relating to authorization for the creation of a county ethics
810 commission in certain counties.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Section 161.001, Local Government Code, is
1113 amended to read as follows:
1214 Sec. 161.001. APPLICABILITY OF CHAPTER. This chapter
1315 applies only to:
1416 (1) a county that:
1517 (A) has a population of 800,000 or more;
1618 (B) is located on the international border; and
1719 (C) before September 1, 2009, had a county ethics
1820 board appointed by the commissioners court;
1921 (2) a county that:
2022 (A) has a population of 425,000 or more;
2123 (B) is adjacent to a county with a population of
2224 3.3 million or more; and
2325 (C) contains a portion of the San Jacinto River;
2426 [and]
2527 (3) a county that has a population of less than 40,000
2628 that is adjacent to a county with a population of more than 3.3
2729 million; and
2830 (4) a county that has a population of more than 3.3
2931 million.
3032 SECTION 2. This Act takes effect immediately if it receives
3133 a vote of two-thirds of all the members elected to each house, as
3234 provided by Section 39, Article III, Texas Constitution. If this
3335 Act does not receive the vote necessary for immediate effect, this
3436 Act takes effect September 1, 2021.
