55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the qualifications of judges of certain courts.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 24.001, Government Code, is amended to
1010 read as follows:
1111 Sec. 24.001. [AGE] QUALIFICATION OF JUDGES. A person is not
1212 eligible to serve as a [A] district judge unless the person:
1313 (1) is [must be] at least 25 years old; and
1414 (2) has never been found to be a vexatious litigant
1515 under Chapter 11, Civil Practice and Remedies Code.
1616 SECTION 2. Section 25.0014, Government Code, is amended to
1717 read as follows:
1818 Sec. 25.0014. QUALIFICATIONS OF JUDGE. A person is not
1919 eligible to serve as a [The] judge of a statutory county court
2020 unless the person [must]:
2121 (1) is [be] at least 25 years of age;
2222 (2) is [be] a United States citizen and has [have]
2323 resided in the county for at least two years before election or
2424 appointment; [and]
2525 (3) is [be] a licensed attorney in this state who has
2626 practiced law or served as a judge of a court in this state, or both
2727 combined, for the four years preceding election or appointment,
2828 unless otherwise provided for by law; and
2929 (4) has never been found to be a vexatious litigant
3030 under Chapter 11, Civil Practice and Remedies Code.
3131 SECTION 3. Section 25.0033, Government Code, is amended to
3232 read as follows:
3333 Sec. 25.0033. QUALIFICATIONS OF JUDGE. A person is not
3434 qualified to serve as a [The] judge of a statutory probate court
3535 unless the person [must]:
3636 (1) is [be] at least 25 years of age;
3737 (2) is [be] a United States citizen and has [have]
3838 resided in the county for at least two years before election or
3939 appointment; [and]
4040 (3) is [be] a licensed attorney in this state who has
4141 practiced law or served as a judge of a court in this state, or both
4242 combined, for the five years preceding election or appointment,
4343 unless otherwise provided for by law; and
4444 (4) has never been found to be a vexatious litigant
4545 under Chapter 11, Civil Practice and Remedies Code.
4646 SECTION 4. The changes in law made by this Act apply only to
4747 a judge who is elected or appointed on or after the effective date
4848 of this Act. A judge elected or appointed before the effective date
4949 of this Act continues to serve for the term to which the judge was
5050 elected or appointed, unless otherwise removed as provided by law.
5151 SECTION 5. This Act takes effect September 1, 2021.
