| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter D, Chapter 38, Utilities Code, is | |
| 11 | 11 | amended by adding Section 38.0721 to read as follows: | |
| 12 | 12 | Sec. 38.0721. EXCLUSION OF CERTAIN FACILITIES FROM ROLLING | |
| 13 | 13 | BLACKOUT. The commission by rule shall require each electric | |
| 14 | 14 | utility, municipally owned utility, and electric cooperative to | |
| 15 | 15 | exclude any circuits that provide power to the following facilities | |
| 16 | 16 | from participation in the utility's or cooperative's attempt to | |
| 17 | 17 | shed load in response to a rolling blackout initiated by an | |
| 18 | 18 | independent organization certified under Section 39.151 or another | |
| 19 | 19 | reliability council or power pool in which the utility or | |
| 20 | 20 | cooperative operates: | |
| 21 | 21 | (1) a facility necessary to provide water to wholesale | |
| 22 | 22 | customers; and | |
| 23 | 23 | (2) a facility necessary to provide natural gas | |
| 24 | 24 | transmission services. | |
| 25 | 25 | SECTION 2. This Act takes effect September 1, 2021. |
