| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 12.092, Health and Safety Code, is |
|---|
| 10 | 10 | | amended by amending Subsection (a) and adding Subsection (c) to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (a) Except as provided in Subsection (c), the [The] |
|---|
| 13 | 13 | | commissioner shall appoint the medical advisory board members from: |
|---|
| 14 | 14 | | (1) persons licensed to practice medicine in this |
|---|
| 15 | 15 | | state, including physicians who are board certified in internal |
|---|
| 16 | 16 | | medicine, psychiatry, neurology, physical medicine, or |
|---|
| 17 | 17 | | ophthalmology and who are jointly recommended by the department and |
|---|
| 18 | 18 | | the Texas Medical Association; and |
|---|
| 19 | 19 | | (2) persons licensed to practice optometry in this |
|---|
| 20 | 20 | | state who are jointly recommended by the department and the Texas |
|---|
| 21 | 21 | | Optometric Association. |
|---|
| 22 | 22 | | (c) The commissioner shall appoint at least one |
|---|
| 23 | 23 | | representative from the following agencies to the medical advisory |
|---|
| 24 | 24 | | board: |
|---|
| 25 | 25 | | (1) the department; and |
|---|
| 26 | 26 | | (2) the Department of Public Safety of the State of |
|---|
| 27 | 27 | | Texas. |
|---|
| 28 | 28 | | SECTION 2. Section 12.094(a), Health and Safety Code, is |
|---|
| 29 | 29 | | amended to read as follows: |
|---|
| 30 | 30 | | (a) The executive commissioner: |
|---|
| 31 | 31 | | (1) shall [may] adopt rules to govern the activities |
|---|
| 32 | 32 | | of the medical advisory board; |
|---|
| 33 | 33 | | (2) shall annually appoint from among the members a |
|---|
| 34 | 34 | | chair and a vice chair of the medical advisory board; |
|---|
| 35 | 35 | | (3) shall annually review the medical advisory board's |
|---|
| 36 | 36 | | rules and internal procedures; |
|---|
| 37 | 37 | | (4) by rule may establish a reasonable fee to pay a |
|---|
| 38 | 38 | | member of the medical advisory board for the member's professional |
|---|
| 39 | 39 | | consultation services; and |
|---|
| 40 | 40 | | (5) [(3)] if appropriate, may authorize reimbursement |
|---|
| 41 | 41 | | for travel expenses as provided by Section 2110.004, Government |
|---|
| 42 | 42 | | Code, for each meeting a member attends. |
|---|
| 43 | 43 | | SECTION 3. Section 12.095, Health and Safety Code, is |
|---|
| 44 | 44 | | amended by adding Subsection (b-1) to read as follows: |
|---|
| 45 | 45 | | (b-1) At least one member of a panel must have medical |
|---|
| 46 | 46 | | expertise relating to the medical condition of the applicant or |
|---|
| 47 | 47 | | license holder whose application or license is being considered by |
|---|
| 48 | 48 | | the panel. |
|---|
| 49 | 49 | | SECTION 4. This Act takes effect September 1, 2021. |
