55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the medical advisory board.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 12.092, Health and Safety Code, is
1010 amended by amending Subsection (a) and adding Subsection (c) to
1111 read as follows:
1212 (a) Except as provided in Subsection (c), the [The]
1313 commissioner shall appoint the medical advisory board members from:
1414 (1) persons licensed to practice medicine in this
1515 state, including physicians who are board certified in internal
1616 medicine, psychiatry, neurology, physical medicine, or
1717 ophthalmology and who are jointly recommended by the department and
1818 the Texas Medical Association; and
1919 (2) persons licensed to practice optometry in this
2020 state who are jointly recommended by the department and the Texas
2121 Optometric Association.
2222 (c) The commissioner shall appoint at least one
2323 representative from the following agencies to the medical advisory
2424 board:
2525 (1) the department; and
2626 (2) the Department of Public Safety of the State of
2727 Texas.
2828 SECTION 2. Section 12.094(a), Health and Safety Code, is
2929 amended to read as follows:
3030 (a) The executive commissioner:
3131 (1) shall [may] adopt rules to govern the activities
3232 of the medical advisory board;
3333 (2) shall annually appoint from among the members a
3434 chair and a vice chair of the medical advisory board;
3535 (3) shall annually review the medical advisory board's
3636 rules and internal procedures;
3737 (4) by rule may establish a reasonable fee to pay a
3838 member of the medical advisory board for the member's professional
3939 consultation services; and
4040 (5) [(3)] if appropriate, may authorize reimbursement
4141 for travel expenses as provided by Section 2110.004, Government
4242 Code, for each meeting a member attends.
4343 SECTION 3. Section 12.095, Health and Safety Code, is
4444 amended by adding Subsection (b-1) to read as follows:
4545 (b-1) At least one member of a panel must have medical
4646 expertise relating to the medical condition of the applicant or
4747 license holder whose application or license is being considered by
4848 the panel.
4949 SECTION 4. This Act takes effect September 1, 2021.
