55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the punishment for the offense of prostitution.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 43.02(c) and (c-1), Penal Code, are
1010 amended to read as follows:
1111 (c) An offense under Subsection (a) is a Class B
1212 misdemeanor, except that the offense is:
1313 (1) a Class A misdemeanor if the actor has previously
1414 been convicted one or two times of an offense under Subsection (a);
1515 or
1616 (2) a state jail felony if the actor:
1717 (A) has previously been convicted three or more
1818 times of an offense under Subsection (a);
1919 (B) is a peace officer;
2020 (C) is a public security officer or reserve law
2121 enforcement officer, as those terms are defined by Section
2222 1701.001, Occupations Code; or
2323 (D) is an employee of a public primary or
2424 secondary school in this state.
2525 (c-1) An offense under Subsection (b) is a Class A
2626 misdemeanor, except that the offense is:
2727 (1) a state jail felony if the actor:
2828 (A) has previously been convicted of an offense
2929 under Subsection (b);
3030 (B) is a peace officer;
3131 (C) is a public security officer or reserve law
3232 enforcement officer, as those terms are defined by Section
3333 1701.001, Occupations Code; or
3434 (D) is an employee of a public primary or
3535 secondary school in this state; or
3636 (2) a felony of the second degree if the person with
3737 whom the actor agrees to engage in sexual conduct is:
3838 (A) younger than 18 years of age, regardless of
3939 whether the actor knows the age of the person at the time of the
4040 offense;
4141 (B) represented to the actor as being younger
4242 than 18 years of age; or
4343 (C) believed by the actor to be younger than 18
4444 years of age.
4545 SECTION 2. The change in law made by this Act applies only
4646 to an offense committed on or after the effective date of this Act.
4747 An offense committed before the effective date of this Act is
4848 governed by the law in effect on the date the offense was committed,
4949 and the former law is continued in effect for that purpose. For
5050 purposes of this section, an offense was committed before the
5151 effective date of this Act if any element of the offense was
5252 committed before that date.
5353 SECTION 3. This Act takes effect September 1, 2021.
