55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to certain claims for benefits, compensation, or
88 assistance by certain public safety employees and survivors of
99 certain public safety employees.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 607.002, Government Code, is amended to
1212 read as follows:
1313 Sec. 607.002. REIMBURSEMENT. (a) A public safety employee
1414 who is exposed to a contagious disease is entitled to reimbursement
1515 from the employing governmental entity for reasonable medical
1616 expenses incurred in treatment for the prevention of the disease
1717 if:
1818 (1) the disease is not an "ordinary disease of life" as
1919 that term is used in the context of a workers' compensation claim;
2020 (2) the exposure to the disease occurs during the
2121 course of the employment; and
2222 (3) the employee requires preventative medical
2323 treatment because of exposure to the disease.
2424 (b) For purposes of this section, a disease is not an
2525 "ordinary disease of life" if the disease is the basis for a
2626 disaster declared by the governor under Section 418.014 for all or
2727 part of the state.
2828 SECTION 2. Subchapter B, Chapter 607, Government Code, is
2929 amended by adding Section 607.0545 to read as follows:
3030 Sec. 607.0545. DISEASES THAT CAUSE A DISASTER DECLARATION.
3131 A firefighter, peace officer, or emergency medical technician who
3232 contracts a disease that is the basis for a disaster declared by the
3333 governor under Section 418.014 for all or part of the state that
3434 results in death or total or partial disability is presumed to have
3535 contracted the disease during the course and scope of employment as
3636 a firefighter, peace officer, or emergency medical technician.
3737 SECTION 3. Section 607.058(a), Government Code, is amended
3838 to read as follows:
3939 (a) A presumption under Section 607.053, 607.054, 607.0545,
4040 607.055, or 607.056 may be rebutted through a showing by a
4141 preponderance of the evidence that a risk factor, accident, hazard,
4242 or other cause not associated with the individual's service as a
4343 firefighter, peace officer, or emergency medical technician was a
4444 substantial factor in bringing about the individual's disease or
4545 illness, without which the disease or illness would not have
4646 occurred.
4747 SECTION 4. Section 615.021(e)(1), Government Code, is
4848 amended to read as follows:
4949 (1) "Personal injury" means an injury resulting from:
5050 (A) an external force, an activity, or a disease
5151 caused by or resulting from:
5252 (i) [(A)] a line-of-duty accident; or
5353 (ii) [(B)] an illness caused by
5454 line-of-duty work under hazardous conditions; or
5555 (B) a disease that is the basis for a disaster
5656 declared by the governor under Section 418.014 for all or part of
5757 the state.
5858 SECTION 5. Subchapter B, Chapter 615, Government Code, is
5959 amended by adding Section 615.0211 to read as follows:
6060 Sec. 615.0211. PRESUMPTION OF LINE-OF-DUTY INJURY. (a) In
6161 this section, "line of duty" has the meaning assigned by Section
6262 615.021.
6363 (b) An individual listed under Section 615.003 who suffers a
6464 personal injury resulting from a disease that is the basis for a
6565 disaster declared by the governor under Section 418.014 for all or
6666 part of the state is presumed to have sustained the injury in the
6767 line of duty in the individual's position as described by Section
6868 615.003.
6969 SECTION 6. Section 615.072(c)(1), Government Code, is
7070 amended to read as follows:
7171 (1) "Personal injury" means an injury resulting from:
7272 (A) an external force, an activity, or a disease
7373 caused by or resulting from:
7474 (i) [(A)] a line-of-duty accident; or
7575 (ii) [(B)] an illness caused by
7676 line-of-duty work under hazardous conditions; or
7777 (B) a disease that is the basis for a disaster
7878 declared by the governor under Section 418.014 for all or part of
7979 the state.
8080 SECTION 7. Subchapter D, Chapter 615, Government Code, is
8181 amended by adding Section 615.0721 to read as follows:
8282 Sec. 615.0721. PRESUMPTION OF LINE-OF-DUTY INJURY. (a) In
8383 this section, "line of duty" has the meaning assigned by Section
8484 615.072.
8585 (b) An individual listed under Section 615.071 who suffers a
8686 personal injury resulting from a disease that is the basis for a
8787 disaster declared by the governor under Section 418.014 for all or
8888 part of the state is presumed to have sustained the injury in the
8989 line of duty in the individual's position as described by Section
9090 615.071.
9191 SECTION 8. The changes in law made by this Act apply to a
9292 claim for benefits, compensation, or assistance brought on or after
9393 the effective date of this Act. A claim for benefits, compensation,
9494 or assistance brought before that date is covered by the law in
9595 effect on the date the claim was made, and that law is continued in
9696 effect for that purpose.
9797 SECTION 9. This Act takes effect immediately if it receives
9898 a vote of two-thirds of all the members elected to each house, as
9999 provided by Section 39, Article III, Texas Constitution. If this
100100 Act does not receive the vote necessary for immediate effect, this
101101 Act takes effect September 1, 2021.
