66 AN ACT
77 relating to home-delivered meal services under the Options for
88 Independent Living program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 101A.151, Human Resources Code, is
1111 amended by adding Subdivision (2-a) to read as follows:
1212 (2-a) "Commission" means the Health and Human Services
1313 Commission.
1414 SECTION 2. Subchapter D, Chapter 101A, Human Resources
1515 Code, is amended by adding Section 101A.1541 to read as follows:
1616 Sec. 101A.1541. HOME-DELIVERED MEAL SERVICES: EVALUATION
1717 AND MONITORING. (a) On a quarterly basis the commission shall
1818 evaluate the use of home-delivered meal services under the Options
1919 for Independent Living program by collecting data from all local
2020 area agencies on aging to determine:
2121 (1) the number of:
2222 (A) home-delivered meals requested under the
2323 program;
2424 (B) requests for home-delivered meals that are
2525 approved and denied under the program; and
2626 (C) home-delivered meals that are delivered to
2727 individuals under the program; and
2828 (2) statewide trends related to the provision of
2929 home-delivered meals under the program and the reasons for those
3030 trends.
3131 (b) The commission shall continually monitor the use of
3232 home-delivered meal services under the Options for Independent
3333 Living program, including statewide trends related to the use of
3434 those services, and make any necessary actions to improve the
3535 provision of those services.
3636 (c) Not later than December 1 of each year, the commission
3737 shall:
3838 (1) submit a report containing the results of the
3939 evaluations performed under Subsection (a) and recommendations for
4040 improving the use of home-delivered meals under the Options for
4141 Independent Living program to the governor, the lieutenant
4242 governor, the speaker of the house of representatives, and the
4343 standing committees of the legislature having primary jurisdiction
4444 over health and human services; and
4545 (2) post the report on the commission's Internet
4646 website.
4747 SECTION 3. Not later than December 1, 2021, the Health and
4848 Human Services Commission shall submit the report required by
4949 Section 101A.1541(c), Human Resources Code, as added by this Act.
5050 SECTION 4. This Act takes effect September 1, 2021.
