| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 101A.151, Human Resources Code, is |
|---|
| 11 | 11 | | amended by adding Subdivision (2-a) to read as follows: |
|---|
| 12 | 12 | | (2-a) "Commission" means the Health and Human Services |
|---|
| 13 | 13 | | Commission. |
|---|
| 14 | 14 | | SECTION 2. Subchapter D, Chapter 101A, Human Resources |
|---|
| 15 | 15 | | Code, is amended by adding Section 101A.1541 to read as follows: |
|---|
| 16 | 16 | | Sec. 101A.1541. HOME-DELIVERED MEAL SERVICES: EVALUATION |
|---|
| 17 | 17 | | AND MONITORING. (a) On a quarterly basis the commission shall |
|---|
| 18 | 18 | | evaluate the use of home-delivered meal services under the Options |
|---|
| 19 | 19 | | for Independent Living program by collecting data from all local |
|---|
| 20 | 20 | | area agencies on aging to determine: |
|---|
| 21 | 21 | | (1) the number of: |
|---|
| 22 | 22 | | (A) home-delivered meals requested under the |
|---|
| 23 | 23 | | program; |
|---|
| 24 | 24 | | (B) requests for home-delivered meals that are |
|---|
| 25 | 25 | | approved and denied under the program; and |
|---|
| 26 | 26 | | (C) home-delivered meals that are delivered to |
|---|
| 27 | 27 | | individuals under the program; and |
|---|
| 28 | 28 | | (2) statewide trends related to the provision of |
|---|
| 29 | 29 | | home-delivered meals under the program and the reasons for those |
|---|
| 30 | 30 | | trends. |
|---|
| 31 | 31 | | (b) The commission shall continually monitor the use of |
|---|
| 32 | 32 | | home-delivered meal services under the Options for Independent |
|---|
| 33 | 33 | | Living program, including statewide trends related to the use of |
|---|
| 34 | 34 | | those services, and make any necessary actions to improve the |
|---|
| 35 | 35 | | provision of those services. |
|---|
| 36 | 36 | | (c) Not later than December 1 of each year, the commission |
|---|
| 37 | 37 | | shall: |
|---|
| 38 | 38 | | (1) submit a report containing the results of the |
|---|
| 39 | 39 | | evaluations performed under Subsection (a) and recommendations for |
|---|
| 40 | 40 | | improving the use of home-delivered meals under the Options for |
|---|
| 41 | 41 | | Independent Living program to the governor, the lieutenant |
|---|
| 42 | 42 | | governor, the speaker of the house of representatives, and the |
|---|
| 43 | 43 | | standing committees of the legislature having primary jurisdiction |
|---|
| 44 | 44 | | over health and human services; and |
|---|
| 45 | 45 | | (2) post the report on the commission's Internet |
|---|
| 46 | 46 | | website. |
|---|
| 47 | 47 | | SECTION 3. Not later than December 1, 2021, the Health and |
|---|
| 48 | 48 | | Human Services Commission shall submit the report required by |
|---|
| 49 | 49 | | Section 101A.1541(c), Human Resources Code, as added by this Act. |
|---|
| 50 | 50 | | SECTION 4. This Act takes effect September 1, 2021. |
