| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter F, Chapter 2165, Government Code, is |
|---|
| 11 | 11 | | amended by amending Section 2165.260 and adding Section 2165.2605 |
|---|
| 12 | 12 | | to read as follows: |
|---|
| 13 | 13 | | Sec. 2165.260. RICHARDS-BUSH [TEXAS] MALL [AREA VENDOR |
|---|
| 14 | 14 | | PERMIT]. (a) In this section, "Richards-Bush Mall" [the "Texas mall |
|---|
| 15 | 15 | | area of the Capitol Complex"] means the state-owned property within |
|---|
| 16 | 16 | | the area bounded on the north by Martin Luther King, Jr., Boulevard, |
|---|
| 17 | 17 | | on the east by Brazos Street, on the south by 15th Street, and on the |
|---|
| 18 | 18 | | west by Colorado Street. |
|---|
| 19 | 19 | | (b) The Richards-Bush Mall is designated in recognition of |
|---|
| 20 | 20 | | Ann Richards' and George W. Bush's service as the 45th and 46th |
|---|
| 21 | 21 | | governors of this state, respectively. |
|---|
| 22 | 22 | | (c) The commission shall install a plaque commemorating the |
|---|
| 23 | 23 | | designation in a prominent location on the mall. |
|---|
| 24 | 24 | | Sec. 2165.2605. RICHARDS-BUSH MALL VENDOR PERMIT. (a) In |
|---|
| 25 | 25 | | this section, "Richards-Bush Mall" has the meaning assigned by |
|---|
| 26 | 26 | | Section 2165.260. |
|---|
| 27 | 27 | | (b) Notwithstanding any other law, the State Preservation |
|---|
| 28 | 28 | | Board by rule and in consultation with the commission and other |
|---|
| 29 | 29 | | appropriate state agencies shall establish a process for a vendor |
|---|
| 30 | 30 | | to apply for and obtain from the board a permit that allows the |
|---|
| 31 | 31 | | vendor to sell goods from a rented space during an event authorized |
|---|
| 32 | 32 | | by the board and held on the Richards-Bush Mall [in the Texas mall |
|---|
| 33 | 33 | | area of the Capitol Complex]. |
|---|
| 34 | 34 | | (c) The State Preservation Board is not required to adopt |
|---|
| 35 | 35 | | the rules required under Subsection (b) until the Capitol Complex |
|---|
| 36 | 36 | | master plan developed under Section 2166.105 is implemented and the |
|---|
| 37 | 37 | | Richards-Bush Mall [Texas mall proposed in the plan] is |
|---|
| 38 | 38 | | established. |
|---|
| 39 | 39 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 43 | 43 | | Act takes effect September 1, 2021. |
