6 | 6 | | relating to carrying a handgun on the premises of a public employer. |

7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 8 | | SECTION 1. Section 411.203, Government Code, is amended to |
---|
9 | 9 | | read as follows: |
---|
10 | 10 | | Sec. 411.203. RIGHTS OF EMPLOYERS. (a) This subchapter |
---|
11 | 11 | | does not prevent or otherwise limit the right of a [public or] |
---|
12 | 12 | | private employer to prohibit persons who are licensed under this |
---|
13 | 13 | | subchapter or not otherwise prohibited by state or federal law from |
---|
14 | 14 | | possessing a firearm from carrying a handgun on the premises of the |
---|
15 | 15 | | business. |
---|
16 | 16 | | (b) An employer that is a governmental entity may not |
---|
17 | 17 | | prohibit an employee of the entity from carrying a handgun that the |
---|
18 | 18 | | employee is not otherwise prohibited by state or federal law from |
---|
19 | 19 | | carrying: |
---|
20 | 20 | | (1) on premises owned or leased by the governmental |
---|
21 | 21 | | entity; |
---|
22 | 22 | | (2) while performing the employee's duties on premises |
---|
23 | 23 | | other than premises owned or leased by the governmental entity; or |
---|
24 | 24 | | (3) in any other location or circumstance in which the |
---|
25 | 25 | | employee would otherwise be permitted to carry a handgun under law. |
---|
26 | 26 | | (c) In this section, "premises" has the meaning assigned by |
---|
27 | 27 | | Section 46.035(f) [46.035(f)(3)], Penal Code. |
---|
28 | 28 | | SECTION 2. This Act takes effect immediately if it receives |
---|
29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
---|
30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
---|
32 | 32 | | Act takes effect September 1, 2021. |
