55 AN ACT
66 relating to carrying a handgun on the premises of a public employer.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 411.203, Government Code, is amended to
99 read as follows:
1010 Sec. 411.203. RIGHTS OF EMPLOYERS. (a) This subchapter
1111 does not prevent or otherwise limit the right of a [public or]
1212 private employer to prohibit persons who are licensed under this
1313 subchapter or not otherwise prohibited by state or federal law from
1414 possessing a firearm from carrying a handgun on the premises of the
1515 business.
1616 (b) An employer that is a governmental entity may not
1717 prohibit an employee of the entity from carrying a handgun that the
1818 employee is not otherwise prohibited by state or federal law from
1919 carrying:
2020 (1) on premises owned or leased by the governmental
2121 entity;
2222 (2) while performing the employee's duties on premises
2323 other than premises owned or leased by the governmental entity; or
2424 (3) in any other location or circumstance in which the
2525 employee would otherwise be permitted to carry a handgun under law.
2626 (c) In this section, "premises" has the meaning assigned by
2727 Section 46.035(f) [46.035(f)(3)], Penal Code.
2828 SECTION 2. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2021.
