| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Subchapter B, Chapter 501, Election Code, is | |
| 12 | 12 | amended by adding Section 501.0211 to read as follows: | |
| 13 | 13 | Sec. 501.0211. ELECTION CALLED BY GOVERNING BODY OF | |
| 14 | 14 | POLITICAL SUBDIVISION. (a) The commissioners court of a county | |
| 15 | 15 | may, on the commissioners court's own motion, order a local option | |
| 16 | 16 | election in the county or a justice precinct in the county to | |
| 17 | 17 | determine whether the sale of alcoholic beverages of one or more of | |
| 18 | 18 | the various types and alcoholic contents shall be prohibited or | |
| 19 | 19 | legalized in the county or the justice precinct. | |
| 20 | 20 | (b) The governing body of a municipality may, by resolution, | |
| 21 | 21 | order a local option election to be held in the municipality to | |
| 22 | 22 | determine whether the sale of alcoholic beverages of one or more of | |
| 23 | 23 | the various types and alcoholic contents shall be prohibited or | |
| 24 | 24 | legalized in the municipality. | |
| 25 | 25 | SECTION 2. This Act takes effect September 1, 2021. |
