| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Section 39.101, Utilities Code, is amended by | |
| 10 | 10 | adding Subsection (b-1) to read as follows: | |
| 11 | 11 | (b-1) A retail electric provider may not enroll a customer | |
| 12 | 12 | in a rate plan that allows the provider to use a variable rate | |
| 13 | 13 | pricing structure after the expiration of a rate plan with a | |
| 14 | 14 | fixed-rate pricing structure without the customer's express | |
| 15 | 15 | consent. The consent must be given in a manner that indicates the | |
| 16 | 16 | customer understands that the customer is potentially enrolling in | |
| 17 | 17 | a variable rate plan. The retail electric provider shall provide | |
| 18 | 18 | notice that the plan includes variable rates in an easily readable | |
| 19 | 19 | font and type size. | |
| 20 | 20 | SECTION 2. This Act takes effect September 1, 2021. |
