7 | 7 | | relating to Medicaid reimbursement for dental services provided to |

8 | 8 | | certain adults with disabilities. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 32.054, Human Resources Code, is amended |
---|
11 | 11 | | by adding Subsection (f) to read as follows: |
---|
12 | 12 | | (f) To prevent serious medical conditions and reduce |
---|
13 | 13 | | emergency room visits necessitated by complications resulting from |
---|
14 | 14 | | a lack of access to dental care, the commission shall provide |
---|
15 | 15 | | medical assistance reimbursement for preventive dental services, |
---|
16 | 16 | | including reimbursement for at least one preventive dental care |
---|
17 | 17 | | visit per year, for an adult recipient with a disability who is |
---|
18 | 18 | | enrolled in the STAR+PLUS Medicaid managed care program. This |
---|
19 | 19 | | subsection does not apply to an adult recipient who is enrolled in |
---|
20 | 20 | | the STAR+PLUS home and community-based services (HCBS) waiver |
---|
21 | 21 | | program. This subsection may not be construed to reduce dental |
---|
22 | 22 | | services available to persons with disabilities that are otherwise |
---|
23 | 23 | | reimbursable under the medical assistance program. |
---|
24 | 24 | | SECTION 2. If before implementing any provision of this Act |
---|
25 | 25 | | a state agency determines that a waiver or authorization from a |
---|
26 | 26 | | federal agency is necessary for implementation of that provision, |
---|
27 | 27 | | the agency affected by the provision shall request the waiver or |
---|
28 | 28 | | authorization and may delay implementing that provision until the |
---|
29 | 29 | | waiver or authorization is granted. |
---|
30 | 30 | | SECTION 3. This Act takes effect September 1, 2021. |
---|
