55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to Medicaid reimbursement for dental services provided to
88 certain adults with disabilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 32.054, Human Resources Code, is amended
1111 by adding Subsection (f) to read as follows:
1212 (f) To prevent serious medical conditions and reduce
1313 emergency room visits necessitated by complications resulting from
1414 a lack of access to dental care, the commission shall provide
1515 medical assistance reimbursement for preventive dental services,
1616 including reimbursement for at least one preventive dental care
1717 visit per year, for an adult recipient with a disability who is
1818 enrolled in the STAR+PLUS Medicaid managed care program. This
1919 subsection does not apply to an adult recipient who is enrolled in
2020 the STAR+PLUS home and community-based services (HCBS) waiver
2121 program. This subsection may not be construed to reduce dental
2222 services available to persons with disabilities that are otherwise
2323 reimbursable under the medical assistance program.
2424 SECTION 2. If before implementing any provision of this Act
2525 a state agency determines that a waiver or authorization from a
2626 federal agency is necessary for implementation of that provision,
2727 the agency affected by the provision shall request the waiver or
2828 authorization and may delay implementing that provision until the
2929 waiver or authorization is granted.
3030 SECTION 3. This Act takes effect September 1, 2021.
