9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 65.051(a), Election Code, is amended to | |
11 | 11 | read as follows: | |
12 | 12 | (a) The early voting ballot board shall verify and count | |
13 | 13 | provisional ballots as provided by this subchapter not later than | |
14 | 14 | the 10th [ninth] day after the date of an election. | |
15 | 15 | SECTION 2. Section 87.041, Election Code, is amended by | |
16 | 16 | adding Subsection (h) to read as follows: | |
17 | 17 | (h) The early voting ballot board shall determine whether to | |
18 | 18 | accept mail ballots as provided by this section not later than the | |
19 | 19 | 10th day after the date of an election. | |
20 | 20 | SECTION 3. Section 87.0431(a), Election Code, is amended to | |
21 | 21 | read as follows: | |
22 | 22 | (a) Not later than the 10th day after the local canvass | |
23 | 23 | [election day], the presiding judge of the early voting ballot | |
24 | 24 | board shall deliver written notice of the reason for the rejection | |
25 | 25 | of a ballot to the voter at the residence address on the ballot | |
26 | 26 | application. If the ballot was transmitted to the voter by e-mail | |
27 | 27 | under Subchapter C, Chapter 101, the presiding judge shall also | |
28 | 28 | provide the notice to the e-mail address to which the ballot was | |
29 | 29 | sent. | |
30 | 30 | SECTION 4. This Act takes effect September 1, 2021. |
