| 5 | 13 | | relating to the purchasing of the uniform of certain honorably |

| 6 | 14 | | retired or medically discharged peace officers. |
|---|
| 7 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 16 | | SECTION 1. The heading to Subchapter D, Chapter 614, |
|---|
| 9 | 17 | | Government Code, is amended to read as follows: |
|---|
| 10 | 18 | | SUBCHAPTER D. PURCHASE OF FIREARM OR UNIFORM OF HONORABLY RETIRED, |
|---|
| 11 | 19 | | MEDICALLY DISCHARGED, OR DECEASED PEACE OFFICER |
|---|
| 12 | 20 | | SECTION 2. Subchapter D, Chapter 614, Government Code, is |
|---|
| 13 | 21 | | amended by adding Section 614.055 to read as follows: |
|---|
| 14 | 22 | | Sec. 614.055. PURCHASE OF UNIFORM ISSUED TO HONORABLY |
|---|
| 15 | 23 | | RETIRED AND CERTAIN MEDICALLY DISCHARGED STATE PEACE OFFICERS. (a) |
|---|
| 16 | 24 | | An individual may purchase a uniform from a state agency if: |
|---|
| 17 | 25 | | (1) the individual was a peace officer commissioned by |
|---|
| 18 | 26 | | the agency; |
|---|
| 19 | 27 | | (2) the individual was honorably retired or medically |
|---|
| 20 | 28 | | discharged under conditions other than dishonorable from the |
|---|
| 21 | 29 | | individual's commission by the agency; and |
|---|
| 22 | 30 | | (3) the uniform had been previously issued to the |
|---|
| 23 | 31 | | individual by the agency. |
|---|
| 24 | 32 | | (b) The nearest surviving relative of an individual |
|---|
| 25 | 33 | | described by Subsection (a) may purchase the individual's uniform |
|---|
| 26 | 34 | | from the state agency. |
|---|
| 27 | 35 | | (c) A state agency shall establish the amount, which may not |
|---|
| 28 | 36 | | exceed fair market value, for which a uniform may be purchased under |
|---|
| 29 | 37 | | this section. |
|---|
| 30 | 38 | | (d) An individual who purchases a uniform or on whose behalf |
|---|
| 31 | 39 | | a uniform is purchased under this section may be buried in the |
|---|
| 32 | 40 | | uniform. |
|---|
| 33 | 41 | | SECTION 3. This Act takes effect September 1, 2021. |
