77 relating to candidates who are ineligible for office.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter A, Chapter 145, Election Code, is
1010 amended by adding Section 145.0035 to read as follows:
1111 Sec. 145.0035. SECRETARY OF STATE TO SEEK REMOVAL OF
1212 INELIGIBLE CANDIDATE FROM BALLOT. If the secretary of state
1313 becomes aware of a candidate who has withdrawn, has died, or is
1414 ineligible but whose name has not been omitted from the ballot, the
1515 secretary may petition a district court for appropriate relief.
1616 SECTION 2. This Act takes effect immediately if it receives
1717 a vote of two-thirds of all the members elected to each house, as
1818 provided by Section 39, Article III, Texas Constitution. If this
1919 Act does not receive the vote necessary for immediate effect, this
2020 Act takes effect September 1, 2021.
