77 relating to inaugural contribution limits and the disclosure of
88 inaugural contributions and expenditures.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 401.004(a), Government Code, is amended
1111 to read as follows:
1212 (a) Subject to Section 401.0045, a [A] person may contribute
1313 funds, services, or other things of value to pay the expenses of or
1414 otherwise provide for an inauguration. This contribution is not a
1515 political contribution for purposes of state law regulating
1616 political contributions or prohibiting a contribution by a
1717 corporation or labor organization.
1818 SECTION 2. Subchapter A, Chapter 401, Government Code, is
1919 amended by adding Section 401.0045 to read as follows:
2020 Sec. 401.0045. INAUGURAL CONTRIBUTION LIMITS; DISCLOSURE
2121 STATEMENT. (a) In this section "political committee" has the
2222 meaning assigned by Section 251.001, Election Code.
2323 (b) Inaugural contributions made by a person under Section
2424 401.004 are subject to the following contribution limits:
2525 (1) for a person other than a person described by
2626 Subdivision (3), the total amount of contributions may not exceed
2727 $2,500;
2828 (2) for a political committee, the total amount of
2929 contributions may not exceed $7,500; and
3030 (3) for a corporation that does business with this
3131 state or an officer or other representative of the corporation, the
3232 total amount of contributions may not exceed $7,500.
3333 (c) Not later than the 30th day after the date of the
3434 inauguration, the inaugural committee shall provide to the Texas
3535 Ethics Commission a disclosure statement on the total inaugural
3636 contributions received by the committee and the total expenditures
3737 made by the committee for the inauguration. The disclosure
3838 statement must include:
3939 (1) if the total contributions or expenditures do not
4040 exceed $1,000, a statement that the contributions received or the
4141 expenditures made, as applicable, do not exceed that amount; or
4242 (2) if the total contributions or expenditures exceed
4343 $1,000, an itemized statement of the following:
4444 (A) for each contribution of $500 or more:
4545 (i) the full name and principal address of
4646 the person making the contribution;
4747 (ii) the total amount of the contribution;
4848 and
4949 (iii) the date the contribution was
5050 received by the committee;
5151 (B) for each contribution of less than $500, the
5252 total amount of those contributions;
5353 (C) for each person paid $500 or more by the
5454 committee:
5555 (i) the full name and principal address of
5656 the person;
5757 (ii) the total amount paid to the person;
5858 and
5959 (iii) each purpose for which the person was
6060 paid; and
6161 (D) for all persons paid less than $500 by the
6262 committee:
6363 (i) the total amount of those expenditures;
6464 and
6565 (ii) the total amount for each category of
6666 expenditure.
6767 SECTION 3. The changes in law made by this Act apply only to
6868 inaugural contributions or expenditures made on or after the
6969 effective date of this Act.
7070 SECTION 4. This Act takes effect September 1, 2021.
