9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter A, Chapter 35, Utilities Code, is | |
11 | 11 | amended by adding Section 35.0021 to read as follows: | |
12 | 12 | Sec. 35.0021. WEATHER EMERGENCY PREPAREDNESS. (a) The | |
13 | 13 | commission by rule shall require each provider of generation in the | |
14 | 14 | ERCOT power region to implement measures to prepare the provider's | |
15 | 15 | generation facilities to provide full electric generation service | |
16 | 16 | at ambient temperatures between 0 degrees Fahrenheit and 120 | |
17 | 17 | degrees Fahrenheit. | |
18 | 18 | (b) The commission shall reduce the base capacity rating of | |
19 | 19 | a generation facility that is operated in violation of a rule | |
20 | 20 | adopted under Subsection (a) by 10 percent annually until the | |
21 | 21 | generation facility is no longer in violation or until the base | |
22 | 22 | capacity rating is reduced to zero. | |
23 | 23 | SECTION 2. This Act takes effect September 1, 2021. |
