119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Section 303.001(a), Labor Code, is amended to
1311 read as follows:
1412 (a) The purpose of this chapter is to remove administrative
1513 barriers that impede the response of public community and technical
1614 colleges, community-based organizations, local workforce
1715 development boards, the Texas A&M Engineering Experiment Station,
1816 and the Texas A&M Engineering Extension Service to industry and
1917 workforce training needs and to develop incentives for public
2018 community and technical colleges, community-based organizations,
2119 local workforce development boards, the Texas A&M Engineering
2220 Experiment Station, and the Texas A&M Engineering Extension Service
2321 to provide customized assessment and training in a timely and
2422 efficient manner.
2523 SECTION 2. Section 303.002(b), Labor Code, is amended to
2624 read as follows:
2725 (b) A public community or technical college, the Texas A&M
2826 Engineering Experiment Station, or the Texas A&M Engineering
2927 Extension Service may recover customized assessment and training
3028 costs incurred by the college, station, or service [institution]
3129 if:
3230 (1) there is an actual or projected labor shortage in
3331 the occupation in which training is provided that is not being met
3432 by an existing institution or program in the area; and
3533 (2) the wages at the time of job placement for
3634 individuals who successfully complete customized training at the
3735 public community or technical college, the Texas A&M Engineering
3836 Experiment Station, or the Texas A&M Engineering Extension Service
3937 are equal to the prevailing wage for that occupation in the local
4038 labor market area.
41- SECTION 3. Section 303.003, Labor Code, is amended by
42- amending Subsections (b), (f), (g), and (h) and adding Subsection
43- (d-1) to read as follows:

4441 (b) The skills development fund may be used by public
4542 community and technical colleges, community-based organizations,
4643 local workforce development boards, the Texas A&M Engineering
4744 Experiment Station, and the Texas A&M Engineering Extension Service
4845 as start-up or emergency funds for the following job-training
4946 purposes:
5047 (1) developing customized training programs for
5148 businesses and trade unions; and
5249 (2) sponsoring small and medium-sized business
5350 networks and consortiums.
54- (d-1) The commission by rule shall adopt a procedure under
55- which an employer may seek and obtain direct reimbursement from the
56- skills development fund for costs incurred by the employer in
57- relation to customized training or certification completed by the
58- employer's employees under a grant agreement authorized under this
59- chapter.
6051 (f) The Texas A&M Engineering Experiment Station and the
6152 Texas A&M Engineering Extension Service shall focus the station's
6253 or service's training activities under this chapter on programs
6354 that:
6455 (1) are statewide in nature; or
6556 (2) are not available from a local junior college
6657 district, a local technical college, or a consortium of junior
6758 college districts.
6859 (g) This section does not prohibit the Texas A&M Engineering
6960 Experiment Station or the Texas A&M Engineering Extension Service
7061 from participating in a consortium of junior college districts or
7162 with a technical college that provides training under this chapter.
7263 (h) A community-based organization may apply for money to
7364 participate in a training program only in partnership with a
7465 community and technical college, the Texas A&M Engineering
7566 Experiment Station, or the Texas A&M Engineering Extension Service.
7667 A community-based organization providing services regulated by the
7768 state shall provide evidence of any certification, license, or
7869 registration required by law.
7970 SECTION 4. Section 303.004, Labor Code, is amended to read
8071 as follows:
8172 Sec. 303.004. FUND REVIEW; REPORT BY CERTAIN WORKFORCE
8273 TRAINING PROVIDERS REQUIRED. (a) The Texas Higher Education
8374 Coordinating Board shall review all customized training programs
8475 biennially to verify that state funds are being used appropriately
8576 by public community and technical colleges, the Texas A&M
8677 Engineering Experiment Station, and the Texas A&M Engineering
8778 Extension Service under this chapter.
8879 (b) Not later than October 1 of each even-numbered year, the
8980 Texas A&M Engineering Experiment Station, the Texas A&M Engineering
9081 Extension Service, and each public community or technical college
9182 that provides workforce training under this chapter shall:
9283 (1) conduct a review of the station's, service's, or
9384 college's training programs to:
9485 (A) determine the effectiveness of the programs
9586 in improving the wages of participants who complete the programs;
9687 and
9788 (B) identify strategies for improving the
9889 delivery of workforce training in order to more effectively impact
9990 economic development in this state; and
10091 (2) submit to the commission a detailed written report
10192 summarizing the results of the review for inclusion by the
10293 executive director in the report to the governor and the
10394 legislature required by Section 303.006(c).
10495 (c) If the Texas A&M Engineering Experiment Station, the
10596 Texas A&M Engineering Extension Service, or a public community or
10697 technical college fails to submit a report required by Subsection
10798 (b)(2):
10899 (1) the station, service, or college must refund to
109100 the comptroller any unexpended state funds received by the station,
110101 service, or college under this chapter for the state fiscal
111102 biennium in which the report was due; and
112103 (2) the commission may not award any additional grant
113104 to the station, service, or college under this chapter until the
114105 station, service, or college has complied with that reporting
115106 requirement.
116- SECTION 5. This Act takes effect September 1, 2021.
107+ SECTION 5. This Act takes effect immediately if it receives
108+ a vote of two-thirds of all the members elected to each house, as
109+ provided by Section 39, Article III, Texas Constitution. If this
110+ Act does not receive the vote necessary for immediate effect, this
111+ Act takes effect September 1, 2021.
