66 AN ACT
77 relating to a divorce on the ground of insupportability.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 6.001, Family Code, is amended to read as
1010 follows:
1111 Sec. 6.001. INSUPPORTABILITY. On the petition of either
1212 party to a marriage, the court may grant a divorce without regard to
1313 fault if both parties to the marriage agree that the marriage has
1414 become insupportable because of discord or conflict of
1515 personalities that destroys the legitimate ends of the marital
1616 relationship and prevents any reasonable expectation of
1717 reconciliation.
1818 SECTION 2. The change in law made by this Act applies only
1919 to a suit for divorce that is filed on or after the effective date of
2020 this Act. A suit for divorce filed before the effective date of
2121 this Act is governed by the law in effect immediately before the
2222 effective date of this Act, and the former law is continued in
2323 effect for that purpose.
2424 SECTION 3. This Act takes effect September 1, 2021.
