66 AN ACT
77 relating to work requirements and employment and training services
88 for certain persons receiving benefits under the supplemental
99 nutrition assistance program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 33, Human Resources Code,
1212 is amended by adding Sections 33.016 and 33.017 to read as follows:
1313 Sec. 33.016. CERTAIN EXEMPTIONS FROM SNAP WORK REQUIREMENTS
1414 PROHIBITED. The commission may not:
1515 (1) request a waiver of the applicability of work
1616 requirements as authorized under 7 U.S.C. Section 2015(o)(4); or
1717 (2) provide an exemption from work requirements as
1818 authorized under 7 U.S.C. Section 2015(o)(6).
1919 Sec. 33.017. EMPLOYMENT AND TRAINING SERVICES FOR CERTAIN
2020 SNAP RECIPIENTS. The commission, in conjunction with the Texas
2121 Workforce Commission, shall ensure that a person who is at least 18
2222 years of age but younger than 50 years of age, who has no
2323 dependents, and who does not have a disability receives
2424 supplemental nutrition assistance program employment and training
2525 services unless the person is eligible for an individual waiver
2626 under the program.
2727 SECTION 2. The changes in law made by this Act apply only to
2828 an initial determination or recertification of eligibility for the
2929 supplemental nutrition assistance program under Chapter 33, Human
3030 Resources Code, that is made on or after the effective date of this
3131 Act. A determination or recertification made before the effective
3232 date of this Act is governed by the law in effect on the date the
3333 determination or recertification was made, and the former law is
3434 continued in effect for that purpose.
3535 SECTION 3. If before implementing any provision of this Act
3636 a state agency determines that a waiver or authorization from a
3737 federal agency is necessary for implementation of that provision,
3838 the agency affected by the provision shall request the waiver or
3939 authorization and may delay implementing that provision until the
4040 waiver or authorization is granted.
4141 SECTION 4. This Act takes effect September 1, 2021.
