| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 76.101, Agriculture Code, is amended by | |
| 11 | 11 | adding Subsection (e) to read as follows: | |
| 12 | 12 | (e) The department, by appropriate means under this | |
| 13 | 13 | chapter, shall prohibit the application of a herbicide containing | |
| 14 | 14 | glyphosate on the grounds of a public or private school or | |
| 15 | 15 | institution of higher education. The department may allow the | |
| 16 | 16 | application of a herbicide containing glyphosate on the grounds of | |
| 17 | 17 | a high school or institution of higher education only for the | |
| 18 | 18 | purpose of producing a crop as part of an agriculture curriculum or | |
| 19 | 19 | agricultural research. | |
| 20 | 20 | SECTION 2. The Department of Agriculture shall implement | |
| 21 | 21 | Section 76.101(e), Agriculture Code, as added by this Act, not | |
| 22 | 22 | later than the 90th day after the effective date of this Act. | |
| 23 | 23 | SECTION 3. This Act takes effect immediately if it receives | |
| 24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
| 25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
| 26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
| 27 | 27 | Act takes effect September 1, 2021. |
