| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. The heading to Section 64.009, Election Code, is |

| 10 | 10 | | amended to read as follows: |

| 11 | 11 | | Sec. 64.009. VOTING OUTSIDE [VOTER UNABLE TO ENTER] POLLING |

| 12 | 12 | | PLACE. |

| 13 | 13 | | SECTION 2. Section 64.009(a), Election Code, is amended to |

| 14 | 14 | | read as follows: |

| 15 | 15 | | (a) On [If a voter is physically unable to enter the polling |

| 16 | 16 | | place without personal assistance or likelihood of injuring the |
|---|
| 17 | 17 | | voter's health, on] the voter's request, an election officer shall |

| 18 | 18 | | deliver a ballot to the voter at the polling place entrance or curb |

| 20 | 20 | | (1) physically unable to enter the polling place |

| 23 | 23 | | (2) a parent or legal guardian accompanied by the |

| 24 | 24 | | parent's or legal guardian's child. |

| 25 | 25 | | SECTION 3. The heading to Section 85.034, Election Code, is |

| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2021. |
