66 AN ACT
77 relating to the winter weather emergency preparedness of facilities
88 for providing electric service.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 86, Natural Resources
1111 Code, is amended by adding Section 86.044 to read as follows:
1212 Sec. 86.044. WEATHER EMERGENCY PREPAREDNESS. The
1313 commission by rule shall require an operator of a gas well to
1414 implement measures to prepare the well to operate during a weather
1515 emergency.
1616 SECTION 2. Subchapter A, Chapter 35, Utilities Code, is
1717 amended by adding Section 35.0021 to read as follows:
1818 Sec. 35.0021. WINTER WEATHER EMERGENCY PREPAREDNESS. The
1919 commission by rule shall require each provider of generation in the
2020 ERCOT power region to:
2121 (1) ensure that adequate maintenance and inspection of
2222 freeze protection elements is conducted on a timely and repetitive
2323 basis;
2424 (2) inspect and maintain generating unit heat tracing
2525 equipment;
2626 (3) inspect and maintain generating unit thermal
2727 insulation;
2828 (4) make a plan to erect adequate windbreaks and
2929 enclosures, where needed;
3030 (5) develop and annually conduct winter-specific and
3131 plant-specific operator awareness and maintenance training;
3232 (6) ensure that winterization supplies and equipment
3333 are in place before the winter season;
3434 (7) ensure that adequate staffing is in place for cold
3535 weather events;
3636 (8) take preventative action in anticipation of cold
3737 weather events in a timely manner;
3838 (9) install insulation and heated pipes as necessary;
3939 (10) use crushers to break up frozen coal;
4040 (11) ensure that equipment can withstand ambient
4141 temperatures of -40 degrees Fahrenheit for at least two days; and
4242 (12) heat any wind turbines and ensure that the
4343 turbines can withstand temperatures of -22 degrees Fahrenheit for
4444 at least two days.
4545 SECTION 3. Subchapter D, Chapter 38, Utilities Code, is
4646 amended by adding Section 38.074 to read as follows:
4747 Sec. 38.074. WINTER WEATHER EMERGENCY PREPAREDNESS. The
4848 commission by rule shall require each electric cooperative,
4949 municipally owned utility, and transmission and distribution
5050 utility providing transmission or distribution service in the ERCOT
5151 power region to:
5252 (1) ensure that transmission facilities are capable of
5353 performing during cold weather conditions;
5454 (2) ensure that communications responsibility is
5555 placed on more than one system operator or on several key personnel
5656 during an emergency;
5757 (3) consider using persons who are not otherwise
5858 responsible for emergency operations for communications during an
5959 emergency or likely emergency;
6060 (4) conduct critical load review for gas production
6161 and transmission facilities and determine the level of protection
6262 such facilities should be accorded in the event of system stress or
6363 load shedding;
6464 (5) train operators in proper load shedding procedures
6565 and conduct periodic drills to maintain load shedding skills;
6666 (6) install insulation and heated pipes as necessary;
6767 and
6868 (7) ensure that equipment can withstand ambient
6969 temperatures of -40 degrees Fahrenheit for at least two days.
7070 SECTION 4. Subchapter D, Chapter 39, Utilities Code, is
7171 amended by adding Section 39.159 to read as follows:
7272 Sec. 39.159. INDEPENDENT ORGANIZATION COMMUNICATION. An
7373 independent organization certified under Section 39.151 for the
7474 ERCOT power region shall:
7575 (1) communicate with transmission and distribution
7676 utilities, municipally owned utilities, and electric cooperatives
7777 about deteriorating weather conditions in a timely manner; and
7878 (2) provide transmission and distribution utilities,
7979 municipally owned utilities, and electric cooperatives with access
8080 to information about loads on the systems of the utilities and
8181 cooperatives that could be curtailed by the organization to provide
8282 operating reserves or as emergency interruptible load service.
8383 SECTION 5. This Act takes effect September 1, 2021.
