6 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

7 | 13 | | SECTION 1. Sections 388.003(i), (j), and (k), Health and |
---|
8 | 14 | | Safety Code, are amended to read as follows: |
---|
9 | 15 | | (i) A building certified by a national, state, or local |
---|
10 | 16 | | accredited energy efficiency program and determined by the |
---|
11 | 17 | | laboratory to be in compliance with the energy efficiency |
---|
12 | 18 | | requirements of this section may, at the option of the |
---|
13 | 19 | | municipality, be considered in compliance. The United States |
---|
14 | 20 | | Environmental Protection Agency's Energy Star Program |
---|
15 | 21 | | certification of energy code equivalency shall be considered in |
---|
16 | 22 | | compliance. A home energy rating system index utilizing Standard |
---|
17 | 23 | | 301 of the American National Standard for the Calculation and |
---|
18 | 24 | | Labeling of the Energy Performance of Dwelling and Sleeping Units |
---|
19 | 25 | | using an Energy Rating Index, commonly cited as ANSI/RESNET/ICC |
---|
20 | 26 | | 301, as it existed on January 1, 2021, [The Energy Rating Index |
---|
21 | 27 | | Compliance Alternative or subsequent alternative compliance path] |
---|
22 | 28 | | as described by Subsection (j) shall be considered in compliance |
---|
23 | 29 | | provided that: |
---|
24 | 30 | | (1) the building meets the mandatory requirements of |
---|
25 | 31 | | Section R406.2 of the 2018 International Energy Conservation Code; |
---|
26 | 32 | | and |
---|
27 | 33 | | (2) the building thermal envelope is equal to or |
---|
28 | 34 | | greater than the levels of efficiency and solar heat gain |
---|
29 | 35 | | coefficient in Table R402.1.2 or Table R402.1.4 of the 2018 |
---|
30 | 36 | | International Energy Conservation Code. |
---|
31 | 37 | | (j) For the purposes of this chapter, Standard 301 of the |
---|
32 | 38 | | American National Standard for the Calculation and Labeling of the |
---|
33 | 39 | | Energy Performance of Dwelling and Sleeping Units using an Energy |
---|
34 | 40 | | Rating Index, commonly cited as ANSI/RESNET/ICC 301, as it existed |
---|
35 | 41 | | on January 1, 2021, [the Energy Rating Index Compliance Alternative |
---|
36 | 42 | | or subsequent alternative compliance path] used to measure |
---|
37 | 43 | | compliance for single-family residential construction [in an |
---|
38 | 44 | | optional compliance path of the energy efficiency chapter of the |
---|
39 | 45 | | International Residential Code] that uses an energy rating index is |
---|
40 | 46 | | as follows: |

41 | 47 | | (1) for climate zone 2, an energy rating index of: |
---|
42 | 48 | | (A) [65 or lower from September 1, 2016, to |
---|
43 | 49 | | August 31, 2019; |
---|
44 | 50 | | [(B)] 63 or lower from September 1, 2019, to |
---|
45 | 51 | | August 31, 2022; [and] |
---|
46 | 52 | | (B) [(C)] 59 or lower on or after September 1, |
---|
47 | 53 | | 2022; |
---|
48 | 54 | | (C) 57 or lower on or after September 1, 2025; and |
---|
49 | 55 | | (D) 55 or lower on or after September 1, 2028; |
---|
50 | 56 | | (2) for climate zone 3, an energy rating index of: |
