8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Subchapter B, Chapter 62, Labor Code, is amended | |
10 | 10 | by adding Section 62.059 to read as follows: | |
11 | 11 | Sec. 62.059. MINIMUM WAGE FOR ESSENTIAL WORKERS. (a) In | |
12 | 12 | this section, "essential worker" means an individual who is | |
13 | 13 | designated as an essential critical infrastructure worker by the | |
14 | 14 | United States Department of Homeland Security, Cybersecurity and | |
15 | 15 | Infrastructure Security Agency. | |
16 | 16 | (b) Notwithstanding Section 62.051 or 62.151 or any other | |
17 | 17 | law, an employer shall pay to each essential worker employed by the | |
18 | 18 | employer not less than the greater of: | |
19 | 19 | (1) $15 an hour; or | |
20 | 20 | (2) the federal minimum wage under Section 6, Fair | |
21 | 21 | Labor Standards Act of 1938 (29 U.S.C. Section 206). | |
22 | 22 | SECTION 2. This Act takes effect September 1, 2021. |
