55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the content of driver's licenses, commercial driver's
88 licenses, and personal identification certificates.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 521.101, Transportation Code, is amended
1111 by adding Subsection (n) to read as follows:
1212 (n) The application for the personal identification
1313 certificate must provide space for the applicant to identify the
1414 applicant's gender as female, male, or nonbinary/gender diverse.
1515 SECTION 2. Section 521.142, Transportation Code, is amended
1616 by amending Subsection (c) and adding Subsection (j) to read as
1717 follows:
1818 (c) The application must state:
1919 (1) the gender [sex] of the applicant;
2020 (2) the residence address of the applicant, or if the
2121 applicant is a federal judge, a state judge, or the spouse of a
2222 federal or state judge using the procedure developed under Section
2323 521.121(c), the street address of the courthouse in which the
2424 applicant or the applicant's spouse serves as a federal judge or a
2525 state judge;
2626 (3) whether the applicant has been licensed to drive a
2727 motor vehicle before;
2828 (4) if previously licensed, when and by what state or
2929 country;
3030 (5) whether that license has been suspended or revoked
3131 or a license application denied;
3232 (6) the date and reason for the suspension,
3333 revocation, or denial;
3434 (7) whether the applicant is a citizen of the United
3535 States; and
3636 (8) the county of residence of the applicant.
3737 (j) The application must provide space for the applicant to
3838 identify the applicant's gender as female, male, or
3939 nonbinary/gender diverse.
4040 SECTION 3. Section 522.021, Transportation Code, is amended
4141 by amending Subsection (a) and adding Subsection (f) to read as
4242 follows:
4343 (a) An application for a commercial driver's license or
4444 commercial learner's permit must include:
4545 (1) the full name and current residence and mailing
4646 address of the applicant;
4747 (2) a physical description of the applicant, including
4848 gender [sex], height, and eye color;
4949 (3) the applicant's date of birth;
5050 (4) the applicant's social security number, unless the
5151 application is for a non-domiciled commercial driver's license and
5252 the applicant is domiciled in a foreign jurisdiction;
5353 (5) certifications, including those required by 49
5454 C.F.R. Section 383.71(a); and
5555 (6) any other information required by the department.
5656 (f) The application must provide space for the applicant to
5757 identify the applicant's gender as female, male, or
5858 nonbinary/gender diverse.
5959 SECTION 4. Section 522.030(a), Transportation Code, is
6060 amended to read as follows:
6161 (a) A commercial driver's license or commercial learner's
6262 permit must:
6363 (1) be marked:
6464 (A) "Commercial Driver License" or "CDL" for a
6565 commercial driver's license; or
6666 (B) "Commercial Learner's Permit" or "CLP" for a
6767 commercial learner's permit;
6868 (2) be, to the extent practicable, tamper-proof; and
6969 (3) include:
7070 (A) the name and domicile address of the person
7171 to whom it is issued;
7272 (B) the person's photograph;
7373 (C) a physical description of the person,
7474 including gender [sex], height, and eye color;
7575 (D) the person's date of birth;
7676 (E) a number or identifier the department
7777 considers appropriate;
7878 (F) the person's signature;
7979 (G) each class of commercial motor vehicle that
8080 the person is authorized to drive, with any endorsements or
8181 restrictions;
8282 (H) the name of this state; and
8383 (I) the dates between which the license is valid.
8484 SECTION 5. The changes in law made by this Act to Chapters
8585 521 and 522, Transportation Code, apply only to a driver's license,
8686 commercial driver's license, or personal identification
8787 certificate issued or renewed under Chapter 521 or 522,
8888 Transportation Code, on or after January 1, 2022.
8989 SECTION 6. This Act takes effect September 1, 2021.
