7 | 7 | | relating to the content of driver's licenses, commercial driver's |

8 | 8 | | licenses, and personal identification certificates. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 521.101, Transportation Code, is amended |
---|
11 | 11 | | by adding Subsection (n) to read as follows: |
---|
12 | 12 | | (n) The application for the personal identification |
---|
13 | 13 | | certificate must provide space for the applicant to identify the |
---|
14 | 14 | | applicant's gender as female, male, or nonbinary/gender diverse. |
---|
15 | 15 | | SECTION 2. Section 521.142, Transportation Code, is amended |
---|
16 | 16 | | by amending Subsection (c) and adding Subsection (j) to read as |
---|
17 | 17 | | follows: |
---|
18 | 18 | | (c) The application must state: |
---|
19 | 19 | | (1) the gender [sex] of the applicant; |
---|
20 | 20 | | (2) the residence address of the applicant, or if the |
---|
21 | 21 | | applicant is a federal judge, a state judge, or the spouse of a |
---|
22 | 22 | | federal or state judge using the procedure developed under Section |
---|
23 | 23 | | 521.121(c), the street address of the courthouse in which the |
---|
24 | 24 | | applicant or the applicant's spouse serves as a federal judge or a |
---|
25 | 25 | | state judge; |
---|
26 | 26 | | (3) whether the applicant has been licensed to drive a |
---|
27 | 27 | | motor vehicle before; |
---|
28 | 28 | | (4) if previously licensed, when and by what state or |
---|
29 | 29 | | country; |
---|
30 | 30 | | (5) whether that license has been suspended or revoked |
---|
31 | 31 | | or a license application denied; |
---|
32 | 32 | | (6) the date and reason for the suspension, |
---|
33 | 33 | | revocation, or denial; |
---|
34 | 34 | | (7) whether the applicant is a citizen of the United |
---|
35 | 35 | | States; and |
---|
36 | 36 | | (8) the county of residence of the applicant. |
---|
37 | 37 | | (j) The application must provide space for the applicant to |
---|
38 | 38 | | identify the applicant's gender as female, male, or |
---|
39 | 39 | | nonbinary/gender diverse. |
---|
40 | 40 | | SECTION 3. Section 522.021, Transportation Code, is amended |
---|
41 | 41 | | by amending Subsection (a) and adding Subsection (f) to read as |
---|
42 | 42 | | follows: |
---|
43 | 43 | | (a) An application for a commercial driver's license or |
---|
44 | 44 | | commercial learner's permit must include: |
---|
45 | 45 | | (1) the full name and current residence and mailing |
---|
46 | 46 | | address of the applicant; |
---|
47 | 47 | | (2) a physical description of the applicant, including |
---|
48 | 48 | | gender [sex], height, and eye color; |
---|
49 | 49 | | (3) the applicant's date of birth; |
---|
50 | 50 | | (4) the applicant's social security number, unless the |
---|
51 | 51 | | application is for a non-domiciled commercial driver's license and |
---|
52 | 52 | | the applicant is domiciled in a foreign jurisdiction; |
---|
53 | 53 | | (5) certifications, including those required by 49 |
---|
54 | 54 | | C.F.R. Section 383.71(a); and |
---|
55 | 55 | | (6) any other information required by the department. |
---|
56 | 56 | | (f) The application must provide space for the applicant to |
---|
57 | 57 | | identify the applicant's gender as female, male, or |
---|
58 | 58 | | nonbinary/gender diverse. |
---|
59 | 59 | | SECTION 4. Section 522.030(a), Transportation Code, is |
---|
60 | 60 | | amended to read as follows: |
---|
61 | 61 | | (a) A commercial driver's license or commercial learner's |
---|
62 | 62 | | permit must: |
---|
63 | 63 | | (1) be marked: |
---|
64 | 64 | | (A) "Commercial Driver License" or "CDL" for a |
---|
65 | 65 | | commercial driver's license; or |
---|
66 | 66 | | (B) "Commercial Learner's Permit" or "CLP" for a |
---|
67 | 67 | | commercial learner's permit; |
---|
68 | 68 | | (2) be, to the extent practicable, tamper-proof; and |
---|
69 | 69 | | (3) include: |
---|
70 | 70 | | (A) the name and domicile address of the person |
---|
71 | 71 | | to whom it is issued; |
---|
72 | 72 | | (B) the person's photograph; |
---|
73 | 73 | | (C) a physical description of the person, |
---|
74 | 74 | | including gender [sex], height, and eye color; |
---|
75 | 75 | | (D) the person's date of birth; |
---|
76 | 76 | | (E) a number or identifier the department |
---|
77 | 77 | | considers appropriate; |
---|
78 | 78 | | (F) the person's signature; |
---|
79 | 79 | | (G) each class of commercial motor vehicle that |
---|
80 | 80 | | the person is authorized to drive, with any endorsements or |
---|
81 | 81 | | restrictions; |
---|
82 | 82 | | (H) the name of this state; and |
---|
83 | 83 | | (I) the dates between which the license is valid. |
---|
84 | 84 | | SECTION 5. The changes in law made by this Act to Chapters |
---|
85 | 85 | | 521 and 522, Transportation Code, apply only to a driver's license, |
---|
86 | 86 | | commercial driver's license, or personal identification |
---|
87 | 87 | | certificate issued or renewed under Chapter 521 or 522, |
---|
88 | 88 | | Transportation Code, on or after January 1, 2022. |
---|
89 | 89 | | SECTION 6. This Act takes effect September 1, 2021. |
