66 AN ACT
77 relating to the continuation and application of the Texas Economic
88 Development Act.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 313.007, Tax Code, is amended to read as
1111 follows:
1212 Sec. 313.007. EXPIRATION. Subchapters B and C expire
1313 December 31, 2034 [2022].
1414 SECTION 2. Section 313.024(b), Tax Code, is amended to read
1515 as follows:
1616 (b) To be eligible for a limitation on appraised value under
1717 this subchapter, the entity must use the property for:
1818 (1) manufacturing;
1919 (2) research and development;
2020 (3) a clean coal project, as defined by Section 5.001,
2121 Water Code;
2222 (4) an advanced clean energy project, as defined by
2323 Section 382.003, Health and Safety Code;
2424 (5) renewable energy electric generation;
2525 (6) electric power generation using integrated
2626 gasification combined cycle technology;
2727 (7) nuclear electric power generation;
2828 (8) a computer center primarily used in connection
2929 with one or more activities described by Subdivisions (1) through
3030 (7) conducted by the entity; [or]
3131 (9) a Texas priority project;
3232 (10) an administrative office; or
3333 (11) a distribution warehouse.
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2021.
