9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 351.101, Tax Code, is amended by adding | |
11 | 11 | Subsection (t) to read as follows: | |
12 | 12 | (t) In addition to the purposes provided by Subsection (a), | |
13 | 13 | a municipality with a population of more than 7,500 but less than | |
14 | 14 | 12,000 that has at least one hotel within 350 feet of a city park and | |
15 | 15 | is wholly located in a county with a population of more than 1.8 | |
16 | 16 | million but less than 2.3 million may use revenue from the hotel | |
17 | 17 | occupancy tax to promote tourism and the convention and hotel | |
18 | 18 | industry by constructing, operating, and maintaining a venue, as | |
19 | 19 | defined by Section 334.001(4), Local Government Code, that is a | |
20 | 20 | multiuse sports and entertainment facility located or to be located | |
21 | 21 | in a city park. | |
22 | 22 | SECTION 2. This Act takes effect immediately if it receives | |
23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
26 | 26 | Act takes effect September 1, 2021. |
