7 | 7 | | relating to the electronic Medicaid recipient directories |
---|
8 | 8 | | maintained by Medicaid managed care organizations. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter A, Chapter 533, Government Code, is |
---|
11 | 11 | | amended by adding Section 533.00751 to read as follows: |
---|
12 | 12 | | Sec. 533.00751. RECIPIENT DIRECTORY. (a) The commission |
---|
13 | 13 | | shall ensure that a Medicaid managed care organization: |
---|
14 | 14 | | (1) maintains an accurate electronic directory of |
---|
15 | 15 | | contact information for each recipient enrolled in the |
---|
16 | 16 | | organization's managed care plan, including each recipient's: |
---|
17 | 17 | | (A) home and mobile telephone numbers; |
---|
18 | 18 | | (B) e-mail address; and |
---|
19 | 19 | | (C) home address; and |
---|
20 | 20 | | (2) updates the electronic directory required under |
---|
21 | 21 | | Subdivision (1) at least monthly. |
---|
22 | 22 | | (b) At least monthly, a Medicaid managed care organization |
---|
23 | 23 | | shall send an electronic copy of the recipient directory described |
---|
24 | 24 | | by this section to the commission. |
---|
25 | 25 | | SECTION 2. (a) The Health and Human Services Commission |
---|
26 | 26 | | shall, in a contract between the commission and a managed care |
---|
27 | 27 | | organization under Chapter 533, Government Code, that is entered |
---|
28 | 28 | | into or renewed on or after the effective date of this Act, require |
---|
29 | 29 | | that the managed care organization comply with Section 533.00751, |
---|
30 | 30 | | Government Code, as added by this Act. |
---|
31 | 31 | | (b) The Health and Human Services Commission shall seek to |
---|
32 | 32 | | amend contracts entered into with managed care organizations under |
---|
33 | 33 | | Chapter 533, Government Code, before the effective date of this Act |
---|
34 | 34 | | to require those managed care organizations to comply with Section |
---|
35 | 35 | | 533.00751, Government Code, as added by this Act. To the extent of a |
---|
36 | 36 | | conflict between that section and a provision of a contract with a |
---|
37 | 37 | | managed care organization entered into before the effective date of |
---|
38 | 38 | | this Act, the contract provision prevails. |
---|
39 | 39 | | SECTION 3. If before implementing any provision of this Act |
---|
40 | 40 | | a state agency determines that a waiver or authorization from a |
---|
41 | 41 | | federal agency is necessary for implementation of that provision, |
---|
42 | 42 | | the agency affected by the provision shall request the waiver or |
---|
43 | 43 | | authorization and may delay implementing that provision until the |
---|
44 | 44 | | waiver or authorization is granted. |
---|
45 | 45 | | SECTION 4. This Act takes effect immediately if it receives |
---|
46 | 46 | | a vote of two-thirds of all the members elected to each house, as |
---|
47 | 47 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
48 | 48 | | Act does not receive the vote necessary for immediate effect, this |
---|
49 | 49 | | Act takes effect September 1, 2021. |
