66 AN ACT
77 relating to the electronic Medicaid recipient directories
88 maintained by Medicaid managed care organizations.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 533, Government Code, is
1111 amended by adding Section 533.00751 to read as follows:
1212 Sec. 533.00751. RECIPIENT DIRECTORY. (a) The commission
1313 shall ensure that a Medicaid managed care organization:
1414 (1) maintains an accurate electronic directory of
1515 contact information for each recipient enrolled in the
1616 organization's managed care plan, including each recipient's:
1717 (A) home and mobile telephone numbers;
1818 (B) e-mail address; and
1919 (C) home address; and
2020 (2) updates the electronic directory required under
2121 Subdivision (1) at least monthly.
2222 (b) At least monthly, a Medicaid managed care organization
2323 shall send an electronic copy of the recipient directory described
2424 by this section to the commission.
2525 SECTION 2. (a) The Health and Human Services Commission
2626 shall, in a contract between the commission and a managed care
2727 organization under Chapter 533, Government Code, that is entered
2828 into or renewed on or after the effective date of this Act, require
2929 that the managed care organization comply with Section 533.00751,
3030 Government Code, as added by this Act.
3131 (b) The Health and Human Services Commission shall seek to
3232 amend contracts entered into with managed care organizations under
3333 Chapter 533, Government Code, before the effective date of this Act
3434 to require those managed care organizations to comply with Section
3535 533.00751, Government Code, as added by this Act. To the extent of a
3636 conflict between that section and a provision of a contract with a
3737 managed care organization entered into before the effective date of
3838 this Act, the contract provision prevails.
3939 SECTION 3. If before implementing any provision of this Act
4040 a state agency determines that a waiver or authorization from a
4141 federal agency is necessary for implementation of that provision,
4242 the agency affected by the provision shall request the waiver or
4343 authorization and may delay implementing that provision until the
4444 waiver or authorization is granted.
4545 SECTION 4. This Act takes effect immediately if it receives
4646 a vote of two-thirds of all the members elected to each house, as
4747 provided by Section 39, Article III, Texas Constitution. If this
4848 Act does not receive the vote necessary for immediate effect, this
4949 Act takes effect September 1, 2021.
